MINUTES <br />Planning Commission <br />March 9, 1989 <br />FinaServe <br />Sign Height <br />Variance <br />Appeal <br />(cont.) <br />the Council allowed Union 76 to replace the existing signs <br />with new Union signs when that property was sold. <br />Alternatively, Mr. Wilcox believes that FinaServe does <br />satisfy the requirements for a variance and therefore <br />qualifies for a variance. <br />Mr. Wilcox indicated that the new sign would be blue, there <br />would be less signage, only two posts instead of four, no <br />higher than their existing sign, and is in their opinion, a <br />more attractive sign. Mr. Wilcox stated that he felt the <br />recent remodeling of the station has benefitted the City and <br />felt the new sign would benefit the City as well. <br />Mr. Wilcox stated that the grounds that they are appealing <br />on are that they feel that they should have fair and equal <br />treatment as others have in the past. Mr. Wilcox indicated <br />that there are only three stations including FinaServe with <br />freeway frontage in Little Canada, and two of the stations <br />have existing signs which far exceed the sign FinaServe is <br />proposing. Mr. Wilcox indicated that FinaServe should be <br />able to compete fairly with the other stations by being <br />allowed to install their 30' sign. <br />Mr. Wilcox believes that McDonald's golden arches impair <br />FinaServe's signs visibility. Mr. Wilcox stated that based <br />on this situation, FinaServe should be allowed to install <br />their sign without a variance as Union 76 did or that <br />FinaServe be granted a variance as ConnCo Shoes did. <br />Mr. Wilcox indicated that there are special circumstances <br />which he feels the Commission and Council should consider <br />when deciding to approve FinaServe's request. Mr. Wilcox <br />stated that it is only fair that FinaServe be allowed to <br />change their sign to reflect the new corporate image. <br />Mr. Wilcox felt that FinaServe's freeway frontage was also a <br />special circumstance as well as the overwelming McDonald's <br />sign. <br />Mr. Wilcox stated that FinaServe is not asking for anything <br />more than their present sign, and therefore requested that <br />the Commission grant approval. <br />Mr. Costa indicated that any business that has gone to the <br />lengths that FinaServe did to upgrade their premises should <br />be able to put another sign up if it does not exceed the <br />present nonconformity.' <br />Page 4 <br />
