MINUTES <br />City Council <br />March 23, 1988 <br />Gardner it was noted that Gardner Bros. was required to dedicate 33 feet of <br />Bros. (Cont.) road right -of -way for Desoto. <br />Scalze replied that this is required as part of the PUD Agreement and <br />does not impact on the park charge that Gardner Bros. will be required <br />to pay. <br />Theis <br />Property <br />Division <br />Fahey pointed out that developers have, in the past, wanted to dedicate <br />ponding areas as part of their park charge, but this does not provide <br />the City with usable park land, or the cash to purchase such park land. <br />Scalze reported that the City's intent is to develop a nice park in the <br />area which will be an amenity to the Gardner Bros. development. <br />Fahey reported that Mr. Tom Theis, owner of 644 East County Road D, has <br />requested the division of his property into two lots. The Planning <br />Commission and City Planner recommend approval of the division as it <br />meets all City Code requirements. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 88 -3 -107 - APPROVING THE THEIS <br />PROPERTY DIVISION AS PRESENTED DIVIDING THE <br />PROPERTY AT 644 COUNTY ROAD D INTO TWO LOTS AS <br />THE PROPERTY DIVISION MEETS ALL CITY CODE <br />REQUIREMENTS <br />The foregoing resolution was duly seconded by Mrs. Scalze. <br />Ayes (4) Fahey, Scalze, Collova, Blesener. <br />Nays (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 19, Page 111. <br />Gordy Scalze reported that from information in Council agendas it appears that <br />Howe the easement located to the north of Lot 1, Block 1, Lakeview Estates <br />Driveway can be used for road purposes. <br />Request <br />Mr. Gordy Howe appeared before the Council and reported that he would <br />Agenda like to bring the driveway for Lot 1, Block 1, Lakeview Estates out <br />Item No. 8 the north side of the lot and utilize the road easement as well as <br />the Schletty driveway easement. Howe reported that he is currently <br />negotiating with Mr. Schletty for the use of the driveway. <br />Collova asked the feeling of the Council for requiring Mr. Howe to <br />enter into an agreement with the City stating that he would not be <br />opposed to the improvement of a road on the north side of this lot. <br />Mr. Howe replied that he was willing to enter into such an agreement. <br />Page 2 <br />
