Our office would not recommend the approval of the applicant's <br />variance request because the site is not so restrictive that a <br />conforming solution wouldn't be possible. Our office would <br />instead recommend the applicant pursue design alternatives that <br />would comply with the minimum Ordinance requirements. <br />Building_ Height. The proposed building height as it is defined <br />is within the maximum thirty -six (36) feet required by the <br />Ordinance. <br />Parking. The applicant is proposing thirty -nine (39) off - street <br />parking stalls towards the rear of the lot and on the west side <br />of the site. The Ordinance requires three (3) spaces plus at <br />least one (1) space for each two hundred (200) square feet of <br />floor area. The term "floor area" for the purpose of calculating <br />the number of off - street parking spaces required shall be <br />determined on the basis of the floor area dimensions of the <br />building times the number of floors minus ten (10) percent. For <br />the proposed office building, this equates to twenty -four (24) <br />required parking stalls needed for the office use. The number of <br />parking stalls provided for on the site exceed the required <br />twenty -four (24). <br />Parking Lot Design. The parking stall design drive aisle width <br />and curb cut width have all been found to meet Ordinance <br />requirements. Section 903.050 -8(0) requires a continuous <br />perimeter curb barrier around the entire off - street parking lot. <br />A curb barrier has not been . illustrated on the site plan but will <br />be required. <br />All parking lots must be surfaced and striped according to <br />Ordinance requirements. <br />All open off - street parking areas of five (5) or more spaces must <br />be screened and landscaped from abutting residential districts in <br />compliance with Section 903.020 -G of the Ordinance. <br />Site Access. Access into the site off of Viking Drive meets <br />Ordinance requirements. <br />Loading. The site plan fails to distinguish a designated off - <br />street loading area. The Ordinance requires an off - street <br />loading area for any structure which use requires the receipt or <br />distribution of materials or merchandise by trucks or similar <br />vehicles. Although a law office will require fewer and smaller <br />deliveries than other commercial businesses, it will still be <br />necessary to provide a loading area for deliveries such as UPS <br />packages. Our office would recommend incorporating a ten (10) <br />foot wide by thirty (30) foot deep designated loading area within <br />the parking lot. Loading areas must conform to Section 903.060 <br />of the Little Canada Ordinance. <br />Page 16 <br />
