MEMORANDUM <br />TO: <br />FROM: <br />DATE: <br />RE: <br />FILE NO: <br />BACKGROUND <br />northwest Essoci8ted consultants, inc. <br />Little Canada Planning Commission <br />Stephen Grittman <br />12 September 1989 <br />Little Canada - Campbell Garage CUP <br />758.09 - 89.52 <br />Mr. Greg Campbell has applied for a Conditional Use Permit to <br />allow a second garage on his property at 2881 Edgerton. The <br />property is zoned R -1 and is located just north of LaBore Road. <br />There is currently a single family house on the property with an <br />attached two car garage. The proposed structure is to be located <br />just behind the existing attached garage and would be 24 x 36 <br />feet, 864 square feet in area. <br />ANALYSIS <br />A conditional use permit is required for a second accessory <br />building pursuant to Section 903.02O.D.5., where it states that <br />no building permit shall be issued for the construction of more <br />than one (1) detached or attached private garage for each single <br />family dwelling, except by conditional use permit. This proposed <br />building is actually the first detached garage, therefore, making <br />it a second garage or accessory building which requires a CUP. <br />It should be noted that the CUP request is for a private garage <br />and not for commercial use. Commercial uses are not permitted in <br />R -1 zones. <br />The building must meet all lot requirements as outlined in <br />Section 903.020.D.3 where it states that accessory buildings <br />shall not exceed 15 feet in height, shall be six (6) feet or <br />more from any other building or structure on the same lot and <br />shall not be located within a public drainage, utility, or access <br />easement. In no case shall an accessory building, use or <br />equipment be located closer than ten (10) feet to a rear yard or <br />side yard lot line.
