OTHER ISSUES <br />The applicant proposes to pave most of the area in front of the <br />expansion, as well as the area in front of the existing building. <br />However, he wishes to delay the latter paving until Ryan Drive is <br />upgraded due to settling of the right -of -way area. The <br />acceptability of this proposal should be reviewed by City <br />Council. The entire paved area would be subject to the <br />requirement for a perimeter continuous curb. In addition, all <br />areas not utilized for parking or building must be landscaped and <br />a bond or cash escrow must be submitted to ensure that <br />improvement. <br />RECOMMENDATION <br />We recommend that the rear year encroachment variance be approved <br />subject to: <br />o The encroachment is no more than 6.28 feet, equal to that of <br />the existing building. <br />o The applicant submit written documentation from NSP <br />permitting construction on the easement. <br />o The City Council decides on the timing of the paving <br />improvements. <br />o A performance security is submitted for the landscaping <br />improvements, together with a complete landscape plan. <br />o Comments of other City Staff. <br />cc: Kathy Glanzer <br />John Palacio <br />Don Carley <br />Tom Sweeney <br />Roger Stanke <br />Page 46 <br />
