Mr. McTeague's property extends between Stark and the <br />recently constructed Sylvan Street. As the property is less than <br />20,000 square feet in area, the owner opted not to split the <br />parcel and was exempted from assessments for Sylvan Street. The <br />current request would allow garage access to Sylvan Street and <br />would apparently violate the 30 foot setback from the right -of- <br />way, although the site plan is not certain on this issue. <br />ANALYSIS <br />When Sylvan Street was constructed, this parcel was exempted from <br />the assessments on request from the property owner, since he had <br />inadequate area for two lots and did not wish to subdivide due to <br />location of the house and other property improvements. This <br />request would permit access to Sylvan without the owner being <br />assessed for the benefit of that access. In this regard, the <br />City has three optional paths. First, the permit may be granted <br />as proposed, or second, it may grant the permit with the <br />stipulation that the assessments be levied. Third, it may grant <br />the permit but deny access to Sylvan Street requiring garage <br />access to be only from Stark. <br />Our concern with the third proposal is one of enforcement. Since <br />Sylvan Street was constructed with surmountable curb, it would be <br />very difficult to effectively prohibit the access.
