PLANNING COMMISSION
LITTLE CANADA, MINNESOTA
October 12, 1989
Pursuant to due call and notice thereof a regular
meeting of the Planning Commission of the City of
Little Canada, Minnesota was held on the 12th day of
October, 1989 in the Council Chambers of the City
Center located at 515 Little Canada Road in said City.
Chairman Peter Costa called the meeting to order at
7:30 P.M. and the following members of the Commission
were present at roll call:

There being no corrections to the minutes of September
14, 1989, the minutes stood approved as read.
Mr. Greg Campbell, 2881 Edgerton Street, appeared
before the Commission requesting approval of a
Conditional Use Permit so that he can construct an
accessory garage on his property to be used for storage
purposes and hobbies. Campbell reported that he will
construct the new garage behind his existing garage and
will access the proposed garage by driving through his
existing garage. Campbell reported that he restores
old cars as a hobby and for his own purposes and will
use the new garage for this hobby as well as for
additional storage area.
Herkenhoff stated that there appears to be a lot of
cars at the Campbell home.

Campbell reported that during the summer he did have
six cars, however, sold one and is restoring another.
Campbell reported that he and his wife and three
children live at 2881 Edgerton.
Drabik asked if the car restoration was a only a hobby,
and asked if Mr. Campbell would be using noisy
equipment.
Campbell replied that his car restoration is only a
hobby and reported that he does all his own vehicle
maintenance. Campbell reported that he would be using
an air compressor, but no paint spraying equipment.
Campbell reported that the majority of the time he
would work in the garage between the hours of 3:30 P.M.
and 9 P.M.
Costa asked the size of the garage.
Campbell replied that the garage would be 24 feet by 36
feet.
Drabik stated that there is a problem in her
neighborhood with noise generated by people doing
vehicle maintenance. Drabik asked if the the City had
a noise ordinance.
The City Planner replied that the restrictions in the
Zoning Ordinance refer to PCA standards for noise.
Costa asked if there would be anyone else working in
the garage other than Mr. Campbell.
Campbell replied that there would not unless his
brother helped him out on occasion. Campbell also
pointed out that he will have a small sound - proofed
area within the garage in which he would use noisy
equipment.
The City Planner reported that Code allows a maximum of
1,000 square feet in garage area, and any amount over

that requires a Conditional Use Permit. The total of
Campbell's existing garage and the proposed accessory
garage exceeds 1,000 square feet by about 250 square
feet.
Drabik asked if there will be car parts stored outside.
Campbell replied that there would not.
Costa asked if Campbell has discussed his proposal with
the neighbor that was at the last meeting objecting to
it.
Campbell replied that he did not. Campbell stated that
he did not agree with that neighbor that his proposal
would decrease property values. Campbell reported that
the garage will get outside storage inside. Campbell
reported that he did discuss the matter with his two
neighbors who are adjacent to him, and they have no
objection and offered to help construct the garage.
Costa asked how deep the Campbell property is.
Campbell reported that his lot is 366 feet deep.
Drabik again stated that her concern was with noise.
Campbell reported that the entire garage would be
insulated, and there would be a 3 by 5 foot enclosure
for noisy equipment.
Costa pointed out that this is not to be a commercial
garage.
Drabik asked if Campbell would be fixing cars for
resale.
Campbell replied that he would not.
Drabik pointed out the Planner's recommendation that
the garage match the exterior of the house.
The City Planner reported that the Building Inspector
will review the plans for the garage to ensure that the
exterior matches the house.
Herkenhoff stated that he did not want to see
residential areas becoming commercial.

Campbell replied that it was not his intention to have
a commercial operation.
Mr. DeLonais recommended approval of the Conditional
Use Permit for accessory garage as requested by Mr.
Greg Campbell, 2881 Edgerton, subject to the
recommendations of the City Planner as contained in his
report dated September 12, 1989.
Motion seconded by Drabik.
Motion carried 5 - 0.
Campbell asked how long the permit was valid in the
event that he could not begin constructing the garage
until spring.
The Planner replied that the permit is valid for one
year, and Mr. Campbell can request an extension of the
permit, if necessary.
MCTEAGUE Mr. Terry McTeague, 2565 Stark Street, appeared before
CUP FOR the Commission requesting approval of a Conditional Use
ACCESSORY Permit for an accessory garage. McTeague pointed out
GARAGE that he has a double- fronting lot and while his home
and existing garage front on Stark Street, he is
proposing to construct an accessory garage fronting on
Sylvan. The garage would be used for storage and to
park his son's car. McTeague was concerned with the
recommendation of the City Planner stating that Sylvan
Street should not be used for access unless the
property is assessed for the Sylvan Street improvement.
Drabik asked the size garage proposed.
McTeague replied that he is planning a 24 foot by 30
foot garage.
Pedersen was concerned about the appearance of the
garage on a lot adjacent to lots that are developed
with homes and garages.
Costa asked if the McTeague property was splitable.
McTeague replied that the property could not be divided
without a variance.
The City Planner reported that the total property area
is about 19,000 square feet, and City Code requires a

minimum of 10,000 square feet for residential lots.
McTeague reported that the City granted the property a
variance for lot width when he first bought the
property 12 years ago. McTeague reported that at the
time Sylvan Street was improved, the City deferred the
assessments for the street until such time as the lot
might be divided. McTeague pointed out that the lot
could not be divided without a variance.
Drabik pointed out that by constructing a garage on
Sylvan Street, McTeague would be using the street just
like other property owners along it. Drabik felt it
would not be fair not to assess the property for Sylvan
Street in the event that the street is being used.
Mrs. McTeague pointed out that other property owners
along Sylvan Street are also using sewer and water,
while they would not be.
Drabik asked if the assessments could be broken down,
and the McTeague property only assessed for the street
portion of the improvement.
The Planner replied that that is a possibility.
Costa asked if the garage could be accessed from Stark
Street.
McTeague replied that it could not since the yard is
terraced and there is quite an elevation change.
The City Planner stated that he is concerned about a
precedent being set in allowing Sylvan Street to be
used but not assessing for the cost of the street.
McTeague pointed out that his son would be the only one
using the street, and felt that the rational being used
would justify a two -car family being assessed double
for street access.
The Planner reported that through lots are now allowed
on new plats just because of the problems being
discussed tonight.
Mrs. McTeague pointed out that the property still has
access to Sylvan Street even if a garage is not
constructed.

Mr. McTeague pointed out that he pays higher property
taxes just because of the amount of land he has.
Mr. Schorn, property owner in the area, pointed out
that the Zoning Code only allows one driveway per lot.
McTeague asked if he could construct a car port on the
property without need for a Conditional Use Permit.
The Planner replied that he could, however, the issue
of the second driveway would still exist. The Planner
stated that he has nothing against the garage being
proposed, the issue is the City's assessment policy.
The Planner stated that the garage would probably fill
a hole on the facade of the street, but how could the
City rationalize abating the assessments for the street
on this lot and then allowing access to the street.
The Planner pointed out that the garage could be
constructed, and sometime in the future Mr. and Mrs.
McTeague could sell the property and a home could be
constructed on Sylvan.
McTeague reported that his assessments were not waived,
but deferred until such time as the lot is split.
There is interest accruing on the assessment.
The Planner stated that the City Council will have to
review its assessment policy. If a Conditional Use
Permit is granted, the property owner is allowed access
to the street. The Planner stated that he has
discussed the issue with the City Attorney, who
indicated that the City has the authority to levy the
assessment against the property.
DeLonais pointed out that it is the Council's job to
review its assessment policy.
Drabik agreed, pointing out that the issue for the
Commission is the garage itself.
The Planner stated that if the Commission felt the
garage appropriate in the location proposed, it could
recommend approval subject to Council review of the
assessment issue.
Mr. Herkenhoff recommended approval of the Conditional
Use Permit requested by Mr. Terry McTeague, 2565 Stark
Street, to construct an accessory garage on Sylvan
Street subject to the recommendations of the City

Planner and subject to Council review of the assessment
issue.
Motion seconded by DeLonais.
Motion carried 5 - 0.
ARCILLA Mr. Ely Arcilla appeared before the Commission
VARIANCE requesting a rear yard setback variance in order to
construct a home at 641 Keller Parkway with a 10 foot
rear yard setback.
The City Planner reported that the actual setback of
the closest point of the home would be 16 feet from the
rear property line. The deck proposed is an acceptable
encroachment in the required rear yard.
The Planner pointed out that the rear yard of the lot
abutts the side yard of Lot 10. The required side yard
setback is 10 feet.
Costa asked the size of the home proposed by Mr.
Arcilla.
Arcilla replied that the home would be 3,000 square
feet in size.
Mr. Al Graf, owner of Lot 10, stated that he opposed
the variance request and felt that if the ordinance
requires a 30 foot rear yard setback, that is what the
setback should be. Graf passed out a diagram showing
the area and the location of his home.
Mr. Lepsche, Lakeside Court, stated that he opposed the
variance as well.
Drabik pointed out that the Arcilla home would not be
adjacent to the Graf home, but rather adjacent to the
rear portion of the Graf backyard.
Mr. Dean Hedlund, property owner in the area, stated
that the problem is that the house is too large for the
lot. Hedlund stated that Mr. Arcilla chose a house
plan that does not fit his lot and he is not asking his
neighbors to accept a variance.
Arcilla reported that he is proposing to construct a

6- bedroom home. Arcilla reported that he currently has
a 6- bedroom home and feels that if he is to construct a
new home, he should improve upon what he now has.
Drabik stated that Arcilia should have made sure that
the home he wished to build would fit on the lot prior
to purchasing the property.
Arcilla stated that the problem is not the size of the
lot, but rather its odd shape.
Hedlund stated that the solution to the problem is to
design a house that fits on the lot. Hedlund pointed
out that the lot adjacent to Mr. Arcilla's lot is
vacant and a corner lot. Hedlund was concerned that a
precedent will be set in whatever is done for Mr.
Arcilla.
The City Planner pointed out that the Ordinance
provides for a variance for shallow lots.
Hedlund stated that a 4,000 square foot house could be
designed for the Arcilla lot without need for a
variance.
Graf again stated that he was opposed to the variance
as did Mr. Lepsche and Mr. Hedlund. Graf stated that
he did not want a home that close to his backyard, and
did not feel a variance was warranted just to
accommodate the style home Mr. Arcilla wishes to
construct.
Pedersen asked if Graf was concerned about the setback
or his view to the lake.
Graf replied that he was not concerned about the view,
he did not want a home that close to him. Graf stated
that the ordinance was established to prevent homes
from being constructed on top of one another.
Hedlund again stated that Arcilia chose a house plan
that does not fit his lot and felt it unreasonable to
expect the neighbors to accept a variance.
Arcilla was asked if he would be willing to change the
style of the home proposed.

Arcilla again stated that he wanted to improve on what
he currently has and stated that the plan proposed is
the one that he prefers. Arcilla stated that he spent
a lot of time working on this plan.
Pedersen asked if the property was purchased subject to
a building permit being issued.
Arcilla replied that this was not the case, that he
owned the lot.
Mr. George Warren, Lakeside Court, stated that he
opposed the variance. Mrs. Lepsche stated that she was
opposed to the variance since she felt a precedent
would be set.
Arcilla again stated that it is the shape of the lot
that is the problem and the house plan selected is the
one he prefers.
Drabik stated that the type of house plan Mr. Arcilla
prefers is not the Commission's concern. The problem
is that the neighbors are opposed to the variance, and
it is possible to construct a home on the lot that
would conform to setbacks.
Arcilla stated that he believes his request meets the
conditions as outlined in the City Planner's letter.
DeLonais pointed out that the Commission is a
recommending body, and final decision will be made by
the City Council. DeLonais pointed out that the
neighbors have complied with setback requirements.
DeLonais felt that Arcilla should have investigated the
situation prior to purchasing the lot.
Costa felt that Mr. Arcilla could have an architect
modify the house plan so that it would fit on the lot.
Ms. Drabik recommended that the variance request of Mr.
Ely Arcilla to construct a home at 641 Keller Parkway
with a 10 foot rear yard setback be denied due to the
objections of the neighbors and since the property
appears to be large enough for a home to be constructed
on it that will conform to setback requirements.
Motion seconded by Mr. Herkenhoff.
Motion carried 4 - 1. Mr. Pedersen voting against.

AMENDMENT
TO CUP
TO INCREASE
NUMBER OF
VIDEO GAMES
Mr. Michael Schifsky, representing Bank Shot Billiards,
appeared before the Commission requesting an amendment
to his Conditional Use Permit to increase the number of
video games to 10. Schifsky reported that he planned
to remove an office area for additional space for the
video games. Schifsky reported that the office space
is not used and is not needed.
Schifsky reported that the purpose of increasing the
number of video games is to provide entertainment to
adult customers while they are waiting for tables.
Initially, the thought was that the games would be used
by children, however, it is adults using the games.
Costa asked if there was anyone from the general public
present wishing to comment on this request. There was
not.
Herkenhoff asked if there have been any problems at the
business.
Schifsky reported that there have been no problems, and
his operation is being used as a roll model for other
billiard halls in the Metro area.
Bill Suchy, County Road C resident, stated that there
have been some fights in the parking lot of the center.
Schifsky reported that the Sheriff's Department has not
brought this to his attention and he is in contact with
them on a day -to -day basis.
Suchy stated that the church across the street had a
meeting on the matter.
Schifsky reported that the pastor of the church has
visited the billiard hall and commented on what a nice
facility it was and a place that helps keep younger
people off the street. Schifsky reported that any
problems that have occurred in the parking lot have not
been serious enough that they could not be handled by
the Bank Shot Billiard staff.
Herkenhoff asked if there were any restraints the City
could enforce should there be problems at the billiard
hall.

Pedersen reported that the issue this evening is the
additional video games and not the entire operation.
Herkenhoff stated that his concern was with problems at
the billiard hall, although he has not heard of any.
Mr. DeLonais recommended approval of the amendment to
Conditional Use Permit to increase the number of video
games allowed at Bank Shot Billiards to ten.
Motion seconded by Mr. Pedersen.
Motion carried 5 - 0.
REZONING The City Planner reported that the Council has
COUNTY ROAD initiated action to consider the rezoning of the back
C PROPERTY 135 feet of 89, 83, 77 and 73 County Road C from B-3 to
R -1. The Planner pointed out that these lots will
front on the new Boosalis residential street. This
rezoning would result in only single - family property
fronting on the new street.
Mr. Don Pierce, representing his mother at 77 W. County
Road C, opposed the rezoning and felt it would be a
downgrading of the property value.
Mr. Bill Suchy, 73 W. County Road C, stated that he
would prefer to have his entire lot rezoned to R -1 and
felt this would ensure a nicer residential area for the
existing homes on County Road C.
Nick Boosalis, developer of the Rice at C Center and
the proposed residential road, described the road
location pointing out that the proposal has been
amended moving the road location as it comes in from
County Road C between the Krienke clinic and the home
at 89 W. County Road C. The existing pond in the area
will be reconfigured to allow the road relocation.
Pierce reported that there is an existing garage on his
mother's property at about the 135 foot point suggested
for the rezoning. Pierce also reported that Mr. Kukk
at 83 W. County Road C conducts a business on his
property. Pierce was concerned about the effect of the
rezoning on existing commercial uses of the property.
The City Planner stated that according to his
information there are no buildings at the 135 foot
point.

Pierce disagreed.
The Planner pointed out that the development of the
second shopping center was held to the requirement that
the area behind the center be developed as R -1. The
Planner stated that in order to make a viable
single - family neighborhood, the new road should only
serve single - family property and not commercial.
Therefore, the purpose of the rezoning being considered
this evening is to ensure that single - family homes are
developed on the new street and not commercial.
However, the existing uses of the property would be
grandfathered in.
Pedersen asked how deep the lots were.
The Planner replied that the lots are 360 feet deep
from the property line.
Pierce suggested that there should be a buffer zone
between the B -3 property and the R -1.
The Planner replied that there is not adequate area for
a buffer zone, and buffer zones typically do not face
each other, but occur at back lot lines.
Pierce was concerned that these problems are being
addressed after the Boosalis development has been
approved.
Herkenhoff asked who will pay the assessments for the
street.
The City Planner replied that the lots fronting on the
street will pay the assessments.
Pierce reported that the property owners have been
informed that the assessment for the street will be
approximately $13,000 to $14,000 per lot. Pierce
pointed out that if the lots can be sold for $20,000,
that will only result in a profit of $6,000 for the
property owner. Pierce also pointed out that the
property owner is loosing half of a B -3 lot as well.
Dr. Krienke, owner of 89 W. County Road C, reported
that when he purchased the property as an investment,
it was zoned commercial. Now the City wants to
downgrade the zoning to residential, which downgrades

his investment. Krienke felt the problem was with the
Steneroden property and getting that strip developed.
Krienke felt that rather than develop the Steneroden
property as residential, there should be a denser
zoning of the Steneroden property, which would still
provide a buffer zone for the Iona Lane property.
Krienke felt there should be a buffer zone between the
B -3 property and the R -1, and that the buffer should
occur on the Steneroden property. Krienke reported
that he was in favor of the back 135 feet of the County
Road C properties remaining B -3.
Suchy again stated that he would rather his entire
parcel be rezoned to R -1 to make a better residential
neighborhood.
Pierce stated that he would like to see the property
remain B -3.
Suchy indicated that Mr. Kukk at 83 W. County Road C
would rather his property remain B -3.
Pierce stated that the rezoning would downgrade the
value of the property, plus the assessment for the
street on the back 135 feet would force the property
owner to sell the back lot for little or no profit.
Krienke did not feel that County Road C could be
considered as a nice, residential area.
Boosalis reported that when the second phase of the
retail center was proposed, the Council requested a
master plan for the development of the back property,
including the Steneroden property. Boosalis reported
that he proposed medium - density housing, however, the
Iona Lane neighborhood came in force opposing that
proposal. Iona Lane indicated that they wanted to see
the area developed as single - family residential, and
that is proposal that Boosalis came back with.
Boosalis questioned Pierce's position at this time
supporting commercial zoning across the street from
R -1.
Boosalis pointed out that it took 18 months to develop
the plan, and now there are a few property owners again
opposing it. Boosalis reported that a great deal of
time was taken trying to develop a plan that would work
for everyone and one that was the best solution.
Boosalis felt that the back 135 feet of the County Road

C properties should be rezoned residential in order to
create a nice residential neighborhood. Boosalis
stated that County Road C is a commercial street,
rather than a residential neighborhood.
Pierce felt that the existing B -3 property that will
abutt the residential street should not be rezoned to
conform to Mr. Boosalis's development.
Boosalis replied that this was not his development, but
a proposal that was negotiated with the City and the
Iona Lane residents.
Pierce felt that the County Road C properties not owned
by Mr. Boosalis should have been omitted from his
drawings.
DeLonais asked if the issue of the B -3 lots abutting
the residential street was ever discussed by the
Planning Commission.
The City Planner replied that the issue was discussed.
Pedersen asked if Tax Increment Financing could be used
to reduce the cost of the assessments for the road.
The City Planner replied that TIF is already being used
and resulted in decreasing the assessments to
approximately $13,000 per lot. TIF will be used from
both the commercial and residential portion of the
development. The Planner noted that the project is a
very expensive one since there is a large portion of
the street which is not assessable.
Krienke again suggested that a buffer zone exist on the
Steneroden property.
The Planner noted that in typical land use planning it
is possible to screen along rear lot lines, but not
possible to screen commercial property fronting on a
street directly across from residential property.
Therefore, land use changes usually occur on rear lot

could be looked at to reduce costs to the property
owners.
The City Planner replied that in addition to the TIF

assistance, the City is picking up interest costs. The
Planner did not believe the project could be stretched
any more.
Krienke felt that the B -3 property was worth $5.00 per
square foot, and felt that this is what the County Road
C property owners should be able to get for their
property. Krienke estimated the value of the County
Road C lots at $50,000 each.
Boosalis pointed out that the front portion of the lots
would remain commercial, and there would be enough land
area remaining so that commercial development could
occur on these lots. Boosalis estimated the value of
B -3 property at between $3 and $4 per square foot.
Boosalis pointed out that the portion of the B -3
property that is valuable is that portion in the front
along County Road C. Boosalis felt that the back
portion did not have the same value and only added to
the cost for a developer.
The City Planner pointed out that the City is proposing
to leave a depth of 215 feet of B -3 property along
County Road C. The Planner pointed out that retail
strip centers need frontage rather than depth.
Pierce pointed out that there are other possibilities
for development of the site other than retail.
The Planner agreed, but felt adequate depth was left so
that lots could be combined and developed commercially.
Krienke stated that commercial developments need
adequate parking area, and felt that the back portions
of these lots could be used for this purpose. Krienke
again stated that the County Road C property should be
commercial and a buffer use should occur on the
Steneroden property.
Pierce replied that that issue has already been
explored.
Krienke again expressed concern with the little return
the property owners will get from the sale of the back
portion of their lots as residential, when he believed
the property to be worth $5 per square foot. Krienke
felt that the development of the area should have a
higher density than single - family.

Pierce pointed out that the area is surrounded with
high density development, and the decision has already
been made to develop single - family homes behind the
commercial center. The only issue being considered
this evening is the rezoning of the back portion of the
County Road C properties. Pierce pointed out that the
property owners have stated their positions, believing
that the rezoning would down value their property. The
density issue has already been resolved.
Krienke asked about road assessments if the property
remained commercial.
The Planner replied the lots would still be assessed
for the road if they remained commercial, with the
amount of the assessment being the same since the
assessment was calculated on a per lot basis. However,
if the lots were assessed, the City could not deny
access to the road by the commercial lots, since the
assessment would mean that the City is assuming that
the property benefits by the road.
Boosalis pointed out that in order to get the
assessments down to $13,000 per lot, a certain
build -out rate is necessary for the residential area.
Boosalis suggested that if there is B -3 property
abutting the residential street, the build -out rate for
that street will be greated reduced.
Boosalis again pointed out that he would have been
happy to construct just the commercial portion of the
development, however, the City Council required that
the back portion of the property be developed as well
and it was the Iona Lane residents who said no to
multi - family housing in that area.
Pierce stated that he was opposed to the rezoning at
this time. Krienke was also opposed.
Boosalis again stated that not to rezone will slow the
increment down and adversely effect the project.
Mr. DeLonais recommended that the rezoning of 89, 83,
77, and 73 West County Road C from B -3 to R -1 be denied
due to the opposition of three of the four property
owners to the rezoning at this time.

BACKGROUND
Mr. Greg Campbell has applied for a Conditional Use Permit to
allow a second garage on his property at 2881 Edgerton. The
property is zoned R -1 and is located just north of LaBore Road.
There is currently a single family house on the property with an
attached two car garage. The proposed structure is to be located
just behind the existing attached garage and would be 24 x 36
feet, 864 square feet in area.
ANALYSIS
A conditional use permit is required for a second accessory
building pursuant to Section 903.020.D.5., where it states that
no building permit shall be issued for the construction of more
than one (1) detached or attached private garage for each single
family dwelling, except by conditional use permit. This proposed
building is actually the first detached garage, therefore, making
it a second garage or accessory building which requires a CUP.
It should be noted that the CUP request is for a private garage
and not for commercial use. Commercial uses are not permitted in
R -1 zones.
The building must meet all lot requirements as outlined in
Section 903.020.D.3 where it states that accessory buildings
shall not exceed 15 feet in height, shall be six (6) feet or
more from any other building or structure on the same lot and
shall not be located within a public drainage, utility, or access
easement. In no case shall an accessory building, use or
equipment be located closer than ten (10) feet to a rear yard or
side yard lot line. As shown on the site plan submitted, the
accessory building meets all requirements outlined per Ordinance.

RECOMMENDATION
Based on the above review, our office recommends approval of the
conditional use permit to allow a second accessory building to be
used for hobby or residential storage contingent upon the
following:

BACKGROUND
Mr. Terry McTeague has requested a Conditional Use Permit to
construct a second garage structure on his property at 2565 Stark
Street. Mr. McTeague's property extends between Stark and the
recently constructed Sylvan Street. As the property is less than
20,000 square feet in area, the owner opted not to split the
parcel and was exempted from assessments for Sylvan Street. The
current request would allow garage access to Sylvan Street and
would apparently violate the 30 foot setback from the right -of-
way, although the site plan is not certain on this issue.
ANALYSIS
When Sylvan Street was constructed, this parcel was exempted from
the assessments on request from the property owner, since he had
inadequate area for two lots and did not wish to subdivide due to
location of the house and other property improvements. This
request would permit access to Sylvan without the owner being
assessed for the benefit of that access. In this regard, the
City has three optional paths. First, the permit may be granted
as proposed, or second, it may grant the permit with the
stipulation that the assessments be levied. Third, it may grant
the permit but deny access to Sylvan Street requiring garage
access to be only from Stark.
Our concern with the third proposal is one of enforcement. Since
Sylvan Street was constructed with surmountable curb, it would be
very difficult to effectively prohibit the access. The first
option would establish access without assessment for that access.
Short of requiring a solid fence across the rear of the lot, the
second option appears to be the most viable from the City's
standpoint.

RECOMMENDATION
We recommend that the City approve the Conditional Use Permit for
a second accessory garage subject to the following conditions:
o Proportionate assessments are levied for access to Sylvan
Street.
o In the alternative, a solid fence is constructed prohibiting
driveway access to the new garage.
o The garage is constructed to meet the 30 foot setback
requirement from Sylvan Street.
o Recommendations of other City staff.

Ely and Yvonne Arcilla have requested a setback variance to
allow a 10 foot rear yard setback for Lot 9, Block 2 of
Bloomquist Lakeside Addition, located west of Keller Parkway and
south of Lakeside Court. The submitted request follows the
intention of the applicants to construct a residence upon the
subject site which is of a design which conflicts with the site's
existing setback standards.
The subject site is zoned R -1, Single Family Residential and lies
within the City's Shoreland Overlay District.

ANALYSIS
In evaluating the applicants request, the City Ordinance requires
that such a variance meet the following criteria:
a. Special conditions and circumstances exist which are
peculiar to the land, structure, or building involved.
(1) Special conditions may include exceptional topographic
or water conditions or, in the case of an existing lot
or parcel of record, narrowness, shallowness,
insufficient area or shape of the property.

(2) Special conditions and circumstances may not be
primarily economic in nature.
b. Literal interpretation of the provisions of this Ordinance
would deprive the applicant of rights commonly enjoyed by
other properties in the same district under the terms of
this Ordinance.
c. The special conditions and circumstances do not result from
the actions of the applicant.
d. Granting the variance requested will not confer on the
applicant any special privilege that is denied by this
Ordinance to other lands, structures, or buildings in the
same district.
e. A genuine hardship exists in complying with the literal
terms of this Ordinance.
Based on review of the site's configuration and physical
surroundings, it appears special conditions do exist which are
peculiar to the site and warrant the granting of the requested
variance.
As shown on the submitted site plan, the subject property is
trapezoidal in shape. As such, a typical 30 foot rear yard
setback, as required per Ordinance standards, would severely
limit the site's buildable area and subsequently, present a
hardship to the applicant.
It appears the residence floor plan has responded well to the
inherent natural features of the area via its southerly
orientation toward an existing wetland.
It should be noted that the residence's most severe setback
infringement lies in its outdoor deck and not in its periphery
walls. Therefore, the aesthetic impact of the requested variance
is minimized.
RECOMMENDATION
Review of the applicants setback variance request finds that
special conditions do exist which are peculiar to the subject
site and therefore, warrant the allowance of a 10 foot rear yard
setback. As such, our office recommends approval of the variance
request.

BACKGROUND
Mr. Michael Schifsky, representing Bankshot Billiards Inc., has
submitted a request to amend a conditional use permit to allow up
to ten (10) amusement devices within his billiard center. The
original CUP, approved in the Winter of 1987, stipulated that a
maximum of eight (8) such devices may be allowed within the
facility. The billiard facility in question lies within the Rice
at C Center at 2650 Rice Street. The center is zoned B -3,
General Business.
ANALYSIS
In January of 1987, the City Council approved the applicant's
original CUP request and established a limit of four (4)
amusement devices for a trial period of 120 days. Subsequent
review found that the four amusement devices posed no significant
problems and the Council amended the original CUP to allow a
maximum of eight amusement devices.
It is the view of our office that a maximum of ten (10) such
devices, as proposed by the applicant would not create any
problems or difficulties which may hinder the functioning of the
billiard center. A decision concerning the acceptability of ten
devices is viewed as an issue of City policy to be made by City
Officials.
It should be recognized, however, that the City does retain some
assurance against any detrimental effects caused by the increased
number of amusement devices via the yearly issuance of a business
license.

RECOMMENDATION
It is the view of our office that a decision concerning the
appropriateness of up to ten amusement devices within the
Bankshot Billiards facility is a matter of City policy and should
be made to City Officials. As such, our office offers no formal
recommendation concerning this matter, other than the comments
made within the body of this report.

Miller and Schroeder has submitted a resolution for EDA adoption.
We have a number of reservations about this proposal. Listed
below are those issues we find troubling in this resolution:
• The resolution mentions a specific unit count (100 units).
Unit count and density are Zoning Ordinance performance
standards which vary by unit size and site area. Until
these details are presented, no assurance of unit count can
be given.
• The resolution specifically states that the EDA would own
the facility. We would recommend that the City not involve
itself in ownership of the facility and that private
ownership or other alternatives be investigated prior to
committing to a specific proposal by resolution.
• The resolution states that the construction, ownership, and
operation of the facility by the EDA is consistent with the
policies of the EDA. We are unclear as to the application
of any policies in this regard.
• The resolution states that the facility would address a need
for elderly housing in the City. While there may be a
perceived need for such a project, no such need has been
documented by a competent market study. Indeed, the future
of several recent similar projects should raise enough
concern as to require a full market study prior to any
formal commitments by the City.

• The resolution would grant "preliminary approval" to the
facility. Preliminary approval is a vague term, but is
typically applied to a project in a much more detailed stage
than is the current proposal.
• The resolution authorizes Miller and Schroeder to determine
who is necessary and appropriate to consult on the project.
Consultants to the City would typically have development
review fees passed through to the developer, however, no
development applicant or fees have been filed.
As Dan Wilson stated in a previous correspondence, we are
uncomfortable having a developer draw up a resolution for the
City's adoption in any case. If the Council is attracted to any
or all of the developer's proposals, this could be indicated to
them without a resolution. Such a proposal would require several
stages of review, including Planning Commission review for
rezoning, conditional use permit and site plan review, public
hearings and Council review and approval.

WHEREAS, the Economic Development Authority of the City of
Little Canada (the "Authority") is authorized, under Minnesota
Statutes, Sections 459.090 - 464.108, as amended, to undertake the
development, construction, and financing of multifamily rental
housing facilities for low and moderate income persons and
families) and
WHEREAS, representatives of Miller & Schroeder Financial,
Inc. ( "Miller a Schroeder ") have proposed to the Authority that
it initiate a program to finance the construction of a 100 -unit
multifamily rental housing facility for elderly persons and
elderly families of low and moderate income (the "Facility ") to
be owned and operated by the Authority; and
WHEREAS, the construction, ownership, and operation of the
Facility by the Authority would be consistent with the purposes
and policies of the Authority and would address an elderly
housing need in the City of Little Canada;
NOW, THEREFORE, EE IT RESOLVED THAT;
1. The Authority hereby preliminarily approves the
Facility.
2. Miller a Schroeder is hereby authorised to prepare a
specific proposal for consideration by the Authority to provide
for the acquisition, construction, management, a'nd financing of
the Facility (the "Proposal ") at a cost not to exceed $5,000,000.
It is requested that in such capacity, Miller & Schroeder
identify one or more acceptable sites for the Facility, determine
the cows of the Facility, prepare a financing plan, and submit
reCOmmendatione as to the operation and management of the
Facility. Miller a Schroeder is authorized to consult with
Briggs and Morgan, bond counsel to the Authority, Barthel
Construction, and other professionals and counsel deemed
necessary or appropriate by Miller & Schroeder to prepare the
Proposal.
3. It is understood that Miller If Schroeder will prepare
the Proposal at its own cost and expense. If the Proposal is
accepted by the Authority, Miller a Schroeder will be the
exclusive underwriter for any obligations issued by the Authority
(or the City of Little Canada) to finance the Facility.

Stephen Grittman and I met with representatives from the above.
We briefly discussed their desire to work with the City in
developing an elderly housing project Vitalie Site. They
basically would like the City Economic Development Authority to
own the facility.
They will be present at your Wednesday, October 11, 1989 meeting
to introduce themselves. They will present a resolution for you
to pass saying the City will work with them.
I have reservations about developers presenting resolutions to
Councils. I understand that the Council is anxious to see
additional elderly housing in Little Canada. I would think your
encouraging them to structure a specific proposal for your
review would be adequate.
They did not specifically ask, but I sense they will ask you to
pay for a market study. I told them that market studies are
typically done by developers, then reviewed by the City.
I believe you have two questions before you give a certain level
of interest in elderly housing by the Council:
1. Who do we wish to work with?
2. Exactly what type of elderly project would be supported in
Little Canada? i.e., rent range, services provided,
amenities, type of building.

1. Who to work with:
Barthel Construction has been a residential home builder for
many years. Although they have built elderly projects,
they are using someone else's project as an example. They
may very well be qualified to do the project, I just am not
that familiar with them.
Clearly, there are many elderly housing developers in the
Metro Area. Unfortunately, too many have gone broke.
2. Specific Elderly Project:
I believe most are aware that the Metro Area has an
unusually large number of elderly projects that have
defaulted or are in financial trouble. This is primarily
the result of overbuilding the market and developers who
did not appreciate the complexities of the elderly market.
A long waiting list for subsidized ($100 -$200) units cannot
be construed to substantiate a market for market rate units
($500 - $600).
I suggested to Mr. Wolff from Barthel that a market study was
needed. I further suggested that supportable rent levels be
established so that they could be compared to rents necessary to
break even. Once we know the size of the "gap" we can determine
the feasibility of filling the gap with tax increment dollars or
other sources.
They prefer to have the City own the building, therefore giving
the City "control ". I would suggest that we can provide you with
all the control necessary, through the Zoning Ordinance and TIF
contract. I would be concerned that the "control" might become a
"liability" on an empty building.
Basically, we need specifics of the project before we can
respond. Steve Grittman is available to be at the Council
meeting with Barthel and Miller and Schroeder if you wish.
