July 2, 2013 <br />Dennis Shoup <br />3337 Twin Lake Road <br />Little Canada, MN 55127 <br />FINAL NOTICE <br />RE: Notice of Violation and Abatement (a) 3337 Twin Lake Road <br />Dear Mr. Shoup: <br />Complaints have been received regarding a public nuisance violation on your property at the <br />above referenced address. A notice was mailed to you on June 13, 2013, requesting the grass be <br />cut at your home by June 24th. Upon receipt of this letter, you contacted me to discuss your <br />intent to cut the grass. During this conversation, you indicated that you would be cutting the <br />grass, but were unsure of exactly when that would occur. As I indicated on the phone, the grass <br />as it exists is a nuisance violation and if not corrected the City would abate the nuisance. I <br />specifically mentioned that the entire property needed to be cut by Monday, July lSt (visual <br />inspection from the street would occur on the 1St). In not corrected, city staff would send out the <br />notice of intent to abatement immediately for approval at the next City Council meeting. You <br />indicated that you may be able to cut the front yard by that time. However, upon inspection of <br />the property yesterday, the following violation was still noted: <br />• Grass not maintained in appropriate manner plus excessive weeds present on the <br />property — Municipal Code 601.030(h) <br />If this is not corrected by Tuesday, July 9, 2013, the City will take the necessary steps to abate <br />the nuisance pursuant to Section 601.080 of the Little Canada City Code. (Text Below). City <br />staff would then request the City Council authorize the abatement of this nuisance violation <br />during their meeting at 7:30 p.m. on Wednesday, July 10th, 2013. If the abatement is ordered by <br />the City Council and abatement work proceeds, all costs of the abatement together with a fee in <br />the amount of not more than 25% of the cost to abate the nuisance shall be imposed, except that <br />in no event shall the administrative fee be less than $50.00 shall be assessed for collection on the <br />property taxes. <br />601.080. ABATEMENT OF NUISANCE BY COUNCIL. If after service of notice of <br />intent to abate nuisance, the person served fails to abate the nuisance or make the <br />necessary repairs, alterations or changes in accordance with the direction of the Code <br />Enforcement Officer, the City Council may cause such nuisance to be abated at the <br />
