Hanson <br />MEMORANDUM <br />TO: Mayor Blesener & Members of City Council <br />FROM: Bill Dircks, Public Works Superintendent <br />DATE: July 3, 2013 <br />RE: Sleepy Hollow Apartments Land Swap <br />Dennis Homel, the owner of the Sleepy Hollow Apartment Complex contacted City staff <br />earlier this spring and inquired about expanding his parking on the west side of the <br />property south of the parking garage. Upon investigation it was discovered that the City <br />owns the property he was looking to expand his parking on. The City took possession of <br />the land when the Sleepy Hollow pond outlot was deeded to it by the Heather Oaks <br />Association a few years ago. The parcel juts north on the west side for some reason. <br />Mr. Homel discussed his options with staff to see if he could acquire the property. Staff <br />researched the property and found that there were no deed restrictions regarding type of <br />use on the property and also found that the City should not have a use for the property in <br />the future. Mr. Homel is not inclined to provide monetary reimbursement for the <br />property so a land swap has been proposed. <br />The City has a storm water lift station in the southeast corner of the property that pumps <br />water from Sleepy Hollow Pond up Canabury Drive and into Savage Lake. Staff is <br />proposing the City trade the piece of property on the east side for the piece Mr. Homel <br />wants on the southwest side. This would allow the City to control the property that the <br />lift station and the force main sit on. That may come in handy in the future if work needs <br />to be completed on the station or the force main. <br />I have included a map of the property in question on both sides and I have outlined where <br />the lift station and force main are located. <br />Staff recommends entering into an agreement with Dennis Homel for a land swap <br />involving the two pieces of property discussed above. <br />
