AMENDMENT TO <br />PLANNED UNIT DEVELOPMENT AGREEMENT <br />This Amendment to Planned Unit Development Agreement is <br />made and entered into this day of <br />1990, between the CITY OF LITTLE CANADA, a Municipal <br />corporation of the State of Minnesota, hereinafter called <br />the "City ", and W. BRUCE HUBBARD and DONNA HUBBARD, husband <br />and wife ( "Hubbard "), and TWO, ,S PROPERTIES, INC., a <br />Minnesota corporation ( "Two S "), hereinafter Hubbard and Two <br />S are sometimes jointly referred to as "Owner ". <br />RECITALS: <br />1. Owner is the current owner of the real property <br />and improvements located thereon located in the City of <br />Little Canada, Minnesota, and legally described in Exhibit A <br />hereto attached ( "Premises ") and shown on the survey hereto <br />attached as Exhibit B. <br />2. Tract A of the Premises is presently improved with <br />mini - storage units and Tract B of the Premises is presently <br />improved with an office /warehouse facility. <br />3. The City and a previous owner of the Premises, <br />Tex -Sota Construction, Inc., entered into a Planned Unit <br />Development Agreement dated May 19, 1983 ( "PUD ") affecting <br />the Premises. <br />4. The PUD was recorded as Document No. 2179690 with <br />the County Recorder's office for Ramsey County, Minnesota on <br />May 31, 1983. <br />5. The parties hereto wish to amend the PUD by <br />allowing for the ownership of Tract A and Tract B by <br />separate persons or entities; provided that all of the <br />remaining applicable terms and conditions of the PUD shall <br />apply in the future to both Tract A and Tract B. <br />NOW, THEREFORE, in consideration of the foregoing and <br />on the terms and conditions hereafter set forth, the parties <br />agree as follows: <br />1. Tract A and Tract B may hereafter be separately <br />owned by different persons or entities and accordingly <br />either Tract A or Tract B may be separately conveyed, sold <br />and transferred. <br />2. All of the remaining terms of the PUD, except as <br />Pana GA <br />
