c. The home occupation may involve any of the <br />following: stock -in -trade incidental to the <br />performance of the service, repair or <br />manufacturing which requires equipment other than <br />customarily found in a home, the teaching with <br />musical, dancing and other instruction of more <br />than one (1) pupil at a time. <br />d. Special home occupations may be allowed to <br />accommodate their parking demand through <br />utilization of on- street parking. In such cases <br />where on- street parking facilities are necessary, <br />however, the City Council shall maintain the right <br />to establish the maximum number of on- street <br />spaces permitted and increase or decrease the <br />maximum number when and where changing conditions <br />require additional review. <br />Of the issues raised above, we would expect that potential noise <br />and traffic will be the primary concerns raised. A research <br />report published by the American Planning Association (PAS) in <br />December, 1989, addressed these issues directly. Surveys of <br />neighborhoods where similar facilities operated shown very little <br />impact. One facility studied was in fact located at the end of a <br />cul -de -sac as is the property in question. Excerpts of the <br />article are included in Exhibit B. We believe that the location <br />of this. proposal is beneficial in that the property's rear yard <br />is somewhat more secluded by virtue of its configuration and the <br />surrounding land use (industrial to the north, waterworks to the <br />west). <br />RECOMMENDATION <br />We recommend approval of the Special Home Occupation Permit for <br />101 Yorkton Ridge to allow up to 15 children in a family day care <br />facility. This recommendation is contingent upon compliance with <br />the above criteria as well as full licensing by the State of <br />Minnesota Department of Human Services.
