4.2.7. For other extra services not herein provided for, the City <br />shall pay the Consultant in accordance with the attached Schedule <br />IBu <br />4.2.8. No deductions shall be made from the Consultant's <br />compensation on account of penalty, liquidated damages, or other sums <br />withheld from payment to contractors. <br />4.2.9. If any work performed by the Consultant is abandoned by the <br />contractor or suspended in whole or in part by the City, the <br />Consultant shall be paid for costs and services performed prior to <br />receipt of written notice from the City of such abandonment or <br />suspension. The Consultant shall also be paid for any terminal <br />expenses resulting therefrom in accordance with the attached Schedule <br />"Bn <br />4.2.10. Ala properly documented and authorized payments due from the <br />City to the Consultant shall be made within 30 days of the receipt of <br />the City of the Consultant's statement therefore. <br />SECTION 5. GENERAL PROVISIONS <br />5.1. The Consultant shall act as the City's agent only as provided <br />for within this Agreement. The parties agree that all engineering <br />services provided by the Consultant under this Agreement shall be of <br />the expected standards of the Engineering Profession and that all <br />employees of the Consultant assigned to the various phases of work on <br />this Project shall be experienced and qualified for the work to be <br />done. <br />5.2. It is understood that the Consultant's assignment of on -going <br />personnel to the City's account was a vital consideration relating to <br />Page 15 <br />Page 30 <br />
