He was assessed <br />in 1978 for the improvements on LaBore Road. In 1983 he <br />was again assessed for frontage along Greenbrier. Upon <br />initial review, it appears that Mr. Erickson was assessed <br />due to his large lot size and the ability he would have to <br />split his lot into separate buildable parcels. This <br />premise was confirmed with Don Carley. Upon further <br />research, it was determined that the location of Mr. <br />Erickson's existing structures on the property would <br />prohibit him from splitting a new lot on Greenbrier in <br />conformance with City zoning requirements. As a result, <br />the question comes into play regarding the value of the <br />Greenbrier improvement levied against his property. <br />The principal assessment on LaBore Road totaled $1,587.78. <br />The assessment on Greenbrier totaled $3,336. Because the <br />LaBore assessment was levied first and because that is <br />where Mr. Erickson's service is derived from, one could <br />make the argument that the Greenbrier assessment should not <br />have applied in his case. To -date he has paid principle <br />and interest on this assessment totalling $4,508.60. (This <br />covers payments through 1990.) <br />Ihave reviewed what appears to be the City's assessment <br />policies in the files I have available to me. I can find <br />nothing in these policies that would have mandated this <br />assessment if the lot was not in fact capable of being <br />split.
