MINUTES <br />PLANNING COMMISSION <br />JUNE 14, 1990 <br />pointed out that eventually the house will have to be <br />sold. <br />Steve Garske pointed out that the Planning Commission <br />cannot answer the ownership questions that exist in <br />this situation. Garske felt that the Commission had to <br />look at what would be better for the property, and <br />would the proposal before the Commission provide for <br />better access to Lot 1. <br />Drabik agreed, and stated that the issue is whether or <br />not the proposal met the City's legal requirements. <br />Mrs. Kroiss pointed out that if Lots 1 and 2 are sold, <br />there will be three owners of the wall. Kroiss asked <br />who would be responsible for maintenance of the wall <br />pointing out that it is already cracked. <br />Drabik did not feel the wall should be breached with a <br />stairway. <br />Garske pointed out that the property owner has the <br />right to put a pass- through in the wall right now. <br />Mr. Daubney reported that the property is owned by Ray <br />Kroiss Homes, Inc., which is a corporation, and has <br />nothing to do with the personal matters between Mr. and <br />Mrs. Kroiss. Daubney pointed out that right now there <br />are four lots which are certified and saleable, and if <br />the Commission approves the proposal this evening, <br />there will still be four lots. The proposal before the <br />Commission is to adjust a lot line to provide better <br />vehicular access to Lot 1 and to save trees on the <br />property. <br />Pedersen asked if a proposal met Code requirements if . <br />it was in the Commission's discretion to comment on <br />whether the lots were large lots or small lots. <br />The City Planner stated that when a property is being <br />subdivided, the Commission does have the discretion to <br />take into consideration its effect on the area. <br />However, in this instance, there are already four lots <br />existing. <br />Mrs. Kroiss asked if when the property division was <br />approved several years ago if the City required that <br />Lot 1 would have to be sold and developed prior to Lot <br />2. <br />Page 4 <br />
