MEMORANDUM <br />TO: Planning Commission <br />FROM: Joel Hanson, City Administrator <br />Jessica Jagoe, Code Enforcement Officer <br />,DATE: June 1, 2006 <br />RE: 3161-3167 Spruce Street, Valor CUP Revocations <br />Conditional Use Permit's were issued to the above referenced property for auto retail sales and <br />open and outdoor storage as an accessory use in December of 1999. From almost the onset of <br />Valor's occupancy of the site this property has been a continuous code enforcement issue. Staff <br />has attached a timeline of events with this property owner regarding bringing this property into <br />compliance. <br />The adopted Zoning Administrator's report dated November 30, 1999 required that the storage <br />area conditions were to be completed by December 31, 1999 and paving/parking/landscaping <br />conditions be completed by June 30, 2000. Starting on July 13, 2000, staff was sending letters to <br />the property owner letting them know violations were present on the site and deadlines for <br />completing the items to avoid further enforcement notion. Staff has repeatedly reviewed the <br />conditions of the original CUP with the property owner, Fred Sedaghat, and allowed every <br />opportunity to correct the violations. <br />1n September of 2003, Mr. Sedaghat applied for an amendment to the original CUP and variance <br />to the parking requirements given his inability to bring the property into compliance. hi this <br />application, Mr. Sedaghat was requesting to relocate the sales lotto the front yard, reduce <br />parking requirements, acid up to 150 cars allowed as outdoor storage. Mr. Sedaghat indicated <br />that he was unable to operate his business as originally represented based on drainage concerns <br />and economic changes. In October, the recommendation was to table the requests pending a <br />report from the City Engineer. In November, the City Engineer reviewed the site urd determined <br />that the drainage problem could be corrected with some regrading of the rear lot and that the <br />problem was not a result of neighboring properties. Mr. Sedaghat disagreed with the results of <br />the City Engineer and requested the matter be tabled again to allow time for Valor Enterprises to <br />hire their own engineer. Mr. Sedaghat also indicated that cars remain on his property for 2-3 <br />months at a time, with the possibility they could remain on site for up to a year. He stated he <br />cannot decrease the nwnber of cars based on the demands of his business.
