6. Erosion Control. The Developer shall comply with the <br />approved erosion control plan for the prevention of damage to <br />adjacent property and the control of surface water runoff. As <br />the operation continues, the City may impose additional erosion <br />control requirements if, in the opinion of the City Engineer, <br />they would be useful. The Developer shall comply with the <br />croeion control plans and with any such additional instructions <br />it receives from the City. <br />7. Cleanup. The Developer shall promptly clear any soil, <br />earth or debris resulting from work by the Developer or its <br />agents or assigns. <br />8. Security. The City approves the activities on the <br />property subject to the condition that the Developer provides the <br />required security, pursuant to Little Canada Code, guaranteeing <br />the reconstruction of the public improvements which, in the <br />opinion of the City Engineer, have been damaged by this activity <br />and subject to the time requirements specified in Paragraph 10. <br />The Developer shall filo with the City the appropriate security <br />in an amount equal to Ten Thousand Dollars ($10,000.00). <br />9. Storm Sewer. The Developer warrants that he is not <br />increasing surface storm drainage onto adjacent properties. <br />10. Time Frame. Subject to compliance with the terms of <br />this Contract, the Developer shall be permitted to operate <br />storago, stockpiling, and processing (crushing) of aggregate <br />materials for the purpose of making recycled concrete and asphalt <br />aggregate. The above activities shall cease on or before 31 July <br />1991. The site shall be improved per the approved Site <br />Development Plan, Exhibit B, which shall include the developer <br />paving Lhe roadway access area, controlling dust, and providing <br />adequate berming of the operation as approved by City staff. <br />From 1 August 1991 until 1 August 1992, the developer may <br />stockpile and store processed materials only, and no delivery of <br />unprocessed materials or actual processing of materials shall <br />occur on the property. After 1 August 1992, the stockpiling and <br />storage of aggregate materials shall cease as well, and all <br />activities thenceforth shall be in complete conformance with City <br />regulations, including but not limited to City Codes, Zoning <br />Ordinances, and Subdivision Ordinance. <br />11. Responsibility for Costs. The Developer shall pay all <br />costs incurred by the City in conjunction with the monitoring of <br />the Permit, including, but not limited to, legal, planning, <br />engineering, and inspection expenses incurred in connection with <br />approval and acceptance of the activities on the Property, the <br />preparation of this Agreement, and all reasonable costs and <br />expenses incurred by the City in monitoring and inspecting <br />operation of the work. <br />Page 3 <br />
