You <br />will note that I have prepared two separate Ordinances, which <br />relate to intoxicating liquor and non - intoxicating malt liquor. <br />Two separate Ordinances were drafted because state law and the <br />Little Canada Municipal Code have different requirements for <br />intoxicating liquor and non - intoxicating malt liquor. <br />Several of the provisions in these Ordinances are required <br />to ensure consistency with state law. Under Minnesota Statutes <br />§340A.404, Subd. 10, temporary on -sale licenses for intoxicating <br />liquor may only be issued to clubs or charitable, religious, or <br />other non - profit organizations which have been in existence for <br />at least three years. Minnesota Statutes §340A.403, Subd. 2(a), <br />restricts the issuance of temporary licenses for <br />non - intoxicating malt liquor to clubs or charitable, religious <br />or non - profit organizations, but does not require that those <br />organizations be in existence three years prior to the time of <br />application. In addition, M.S. §340A.404, Subd. 10, restricts <br />the authorization of a temporary license for intoxicating liquor <br />to three consecutive days. Although there is no similar <br />restriction for non - intoxicating liquor in the statutes, the <br />Ordinance also restricts those licenses to no more than three <br />consecutive days for the purposes of consistency. <br />The amount of the fee for either license is subject to the <br />Council's discretion. A fee of $40.00 is provided for in the <br />Ordinances since that is the amount of the fee for on -sale <br />licenses presently in the Code. Both of the enclosed <br />Page 22 <br />
