include the provision of 46 parking spaces (19 for shop area, 20 <br />for office area, and 7 for storage area), proper curbing and <br />paving, and a minimum five foot landscaped setback for the <br />public right -of -way. <br />A second issue is that of process and the general acceptability <br />of requests of this type. The 30 percent restriction is a <br />"carryover" requirement from the business districts, where <br />storage is not a permitted principal use. In such a case, <br />assuring that storage on a business zoned parcel does not in fact <br />become the principal use is an important issue. IL may be that <br />this distinction is less important in an industrial district <br />where storage is an allowed principal use of a building. <br />This all becomes significant since, by our review of the variance <br />criteria, the request does not meet the requirements for <br />uniqueness, hardship, or avoidance of special privilege. <br />However, we believe the request may be appropriate if properly <br />controlled. Such a request would be better addressed by <br />Conditional Use Permit than by variance. <br />If the City believes it is appropriate, we would recommend an <br />amendment to the Ordinance which will consider the following <br />issues: <br />Accessory buildings in excess of 30 percent of the principal use <br />allowed by CUP where: <br />o Proposed accessory use is allowed as principal or accessory <br />use in the zoning district. <br />o Construction similar to principal building. <br />o Site meets all other performance standards of the Zoning <br />Ordinance. <br />o The total accessory building area is less than the principal <br />building area. <br />RECOMMENDATION <br />We recommend that the City consider a text amendment to allow <br />proposals such as Fuel Economy's if it believes such proposals <br />are appropriate.
