Hanson, City Administrator <br />RE: Ganzel Fill Permit <br />MAYOR <br />Michael Fahey <br />COUNCIL <br />Beverly Scalze <br />Bill Weisner <br />Rick CoIlova <br />Jim LaValle <br />It is anticipated that all documentation will be in place to allow <br />the granting of the above - referenced fill permit. City staff will <br />have their recommendation regarding this permit ready for Wednesday's <br />meeting, and it will be presented by Don Carley. <br />Indirectly related to this issue was the problem that the easement <br />acquired from Mr. and Mrs. Ganzel in the condemnation process was <br />discovered to be inadequate in relation to the location of the pipe <br />in question. After further review by our city engineers, it was <br />determined that an additional two feet in width was necessary for <br />about 61 feet of the length of the easement. <br />Based on conversations with the Mayor and our city attorney staff, I <br />have discussed this matter with the Ganzel's. I informed them that I <br />would recommend to the City Council that we pay them the same per <br />square foot cost awarded in the condemnation proceeding (1.36/sq. <br />ft.) for the 122.8 square feet we still need. Thus, our cost would <br />bean additional $167.00 plus document preparation and recording <br />cost. Mr. Ganzel stated he was agreeable to this, and I have <br />directed the City Attorney to prepare the necessary documents. <br />The Ganzel's would like to get the issue of the easement and fill <br />permit put to rest, and we have tentatively discussed signing the <br />easement document on Thursday subject to approval by the Council on <br />Wednesday. <br />Your action is necessary to complete this transaction. <br />PAGE 93 <br />
