It is our belief that, <br />properly regulated, the activity can be allowed. For ease of <br />enforcement, we would recommend that the stockpile be required to <br />be fully screened from the centerline of the adjacent street(s). <br />In this way, the Building Official can monitor the stockpile by <br />merely driving by the site. In addition, the activity should be <br />required to maintain a 40 foot setback from all property lines in <br />order to assure adequate site circulation and control of the <br />storage material on site. By City Ordinance requirement, any <br />principal use of property must have a principal structure of at <br />least 1,000 square feet in area. This must be accompanied by the <br />required paved and curbed parking area, landscaping and <br />additional screening. A landscaped screening area around the <br />perimeter of the site would appear appropriate as well. <br />One of the primary issues with which the City has been dealing <br />on the Frattalone site is that of the duration of the use. If <br />allowed by conditional use permit in the I -1 District, the use <br />could continue indefinitely as long as it complied with zoning <br />Ordinance requirements, including those listed above. An option <br />for the City to consider has become available through a change <br />in state law last year. By mutual agreement, the City and a <br />landowner can establish an "interim use" for any specified period <br />of time by development contract. Interim uses are a category of <br />use in addition to "permitted uses" and "conditional uses ". They <br />are basically the same as conditional uses, but with the time <br />period added.
