CONTRACT FOR HAZARDOUS MATERIALS RESPONSE <br />THIS AGREEMENT is made and entered into this day <br />of .............-- _ - - -.-, 19,..,,,,,, by and between the City of Saint Paul, a <br />municipal corporation organized and existing under the laws of the <br />State of Minnesota, hereinafter referred to as "City ", and LITTLE, <br />CANADA, party of the second part, hereinafter referred to as <br />"Applicant ". <br />WHEREAS, the City Council by Resolution # _..__, authorized the <br />City to enter into a Contract with the APPLICANT, for the provision <br />of equipment and personnel of City's Fire Department for the <br />containment and securing of Hazardous Materials in the County of <br />RAMSEY,, Municipality of LITTLE excepting the disposal <br />thereof. <br />NOW, THEREFORE, in consideration of the mutual promises and <br />agreements contained herein the parties agree as follows: <br />1. DEFINITIONS <br />Unless the language or context clearly indicates that a different <br />meaning is intended, the following words, terms and phrases, for <br />purposes of this contract shall have the meanings hereinafter <br />subjoined to them. <br />Fire Chief - The Fire Chief of the City of St. Paul or the Chief's <br />designee. <br />Hazardous Material - A substance (gas, liquid, or solid) capable <br />of creating harm to people, property, and the environment. <br />Hazardous Materials Incident - A fire involving a hazardous <br />material or a release or potential release of a hazardous material. <br />Hazardous Materials Response Team - A group of trained response <br />personnel operating under an emergency response plan and <br />appropriate standard operating procedures to control or otherwise <br />minimize or eliminate the hazards to people, property, or the <br />environment from a released hazardous material. <br />2. CONTRACT TERM <br />2.1 Term <br />The term of this Contract shall be for a period of one year from <br />to and including unless <br />earlier terminated by law or according to the provisions herein. <br />Page 5 <br />
