HANSON, Administrator <br />515 Little Canada Road <br />Little Canada, MN 55117 <br />612- 484 -2177 <br />FAX: 612-484-4538 <br />CITY OF LITTLE CANADA <br />RAMSEY COUNTY, MINNESOTA <br />MEMORANDUM <br />TO: Mayor Fahey and Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: October 18, 1990 <br />RE: Engineering Contract Amendment <br />Attached you will find a proposed contract amendment <br />between the City and Bonestroo, Rosene, Anderlik & <br />Associates, Inc. This amendment is being proposed to <br />address situations whereby the developer is installing <br />improvements on public right -of -way which the City will <br />ultimately accept, but•which.the City is not responsible <br />for the cost or construction of the improvement (i.e. <br />Slumberland water main on DeSoto /Stanke water main on Ryan <br />Drive /Palmen water main on Viking Drive). Presently these <br />developments would be handled under our contact utilizing <br />the stated hourly rates. Bonestroo feels that these rates <br />are not adequate to compensate them for actual design <br />services especially in light of liability concerns. They <br />have asked that those rates be increased by 30% to address <br />this additional concern related to design. It should be <br />noted that in the case of City projects, design <br />compensation is based on the fee curve. It is also to be <br />understood that should the City have a project that we <br />installed that does not meet the fee curve requirements, <br />our hourly rates will be based on our present contract and <br />without the 1.3 multiplier. <br />I have discussed this with the City Attorney and reviewed <br />it pursuant to our existing contract and i see no reason <br />that we should not execute this amendment. I feel it is <br />fair to the developers in that they will be made aware of <br />these costs on the front end of their projects. Should <br />they feel they are too high, they have the option of <br />retaining their own engineer and submitting plans for <br />review by our engineering staff.
