Upon review of this petition, I discovered that the developers <br />do not have the required 35% frontage to make this a valid petition. <br />(The total frontage is 3318.36 and 1100.00 feet is owned by the <br />Costas. 33.15% is owned by the developer.) To address this problem, <br />we have one of two options. They are: <br />1. The City could sign the petition form, thereby adding the <br />frontage of Pioneer Park to the petition total resulting in <br />the 35% threshold requirement being met. <br />2. The City Council could order the investigation of this <br />project without petition pursuant to the attached <br />resolution. <br />It would be my recommendation that the City order the study of this <br />project without signing the petition form subject to the developers <br />entering into an agreement whereby they are accepting responsibility <br />for the costs associated with this study. It would be further <br />understood that they would deposit an acceptable amount of money to <br />defray the cost of this study as well as Attorney's fees in preparing <br />the developer's agreement with replenishment to a fixed level as <br />deemed necessary. It should be further understood that should the <br />development proceed and costs be assessed, the eligible public <br />improvement costs which they have paid for on the front end of this <br />process would then be added back into the overall public improvement <br />costs and a rebate would be due them. The deposit amount should be <br />based on estimates obtained from the City Attorney and the City <br />Engineer necessary to address their work efforts in this process. <br />JRH:kpv <br />t° Page 57 <br />
