Pursuant to <br />your recommendation to the City Council on June 22, 1990, the <br />Council directed our office to conduct a complete review of the <br />present ordinances and to recommend revisions to make the City's <br />Ordinance consistent with the State Liquor Code. As you will <br />note, due to the substantial nature of the necessary revisions, <br />the Amended Ordinance would completely replace the existing <br />liquor and beer ordinance. <br />Where appropriate, the requirements of State law have been <br />included in the Ordinance. As to a substantial number of the <br />additional provisions, the existing Ordinance is silent. Our <br />recommendation is that the requirements of State law be fully <br />incorporated into the local ordinance for the purposes of <br />clarity, except when the ordinance is more restrictive. <br />You will note that the types of licenses to be issued under <br />the enclosed Ordinance differ from those presently issued. <br />Since it is my understanding that temporary on-sale licenses for <br />both intoxicating liquor and non - intoxicating malt liquor are <br />presently issued under certain circumstances, i have added <br />provisions for temporary licenses in the proposed ordinance. In <br />Chapter 703, I have incorporated the classes of licenses <br />designated as "On -Sale A Restaurant" and "On-Sale B Tavern." <br />You will note that under the terms of the enclosed Ordinance, <br />permanent on -sale intoxicating liquor licenses will be limited <br />Page 50 <br />
