DEC -21 -1990 12:55 FROM SWEENEY a BORER
Mr. Joel R. Hanson
December 21, 1990
Page Three
Tn LITTLE- CPNHDR P.04/24
Section 704.050 of the enclosed Ordinance does provide for
a combination wine and beer license. Such a license is
authorized by Minnesota Statutes §340A.404, Subdivision 5(b).
Please note that such a combination license can only be issued
to a business whose gross receipts are at least 60% attributable
to the sale of food. In the absence of such a provision in the
Ordinance, separate licenses would be required.
As indicated previously, temporary on -sale licenses,
otherwise known as special event licenses, are provided for in
the Ordinance. Pursuant to our previous conversations, the
enclosed Ordinance requires that all licensees provide proof of
financial responsibility, regardless of the amount of alcohol to
be sold and even for temporary on -sale licensees. ( See Section
702.030(2) and 703.040(6).) The proposed Ordinance also
requires that a temporary licensee for a special event held on
City property must name the City as an additional insured. This
is a crucial provision since any time an event is held on City
property, there is a possibility that the City may be named as a
defendant in the event of litigation.
Once you have had an opportunity to review the enclosed
Ordinance, please contact me in order that we may discuss it
further.
PTO:lmg
Enclosure
Very truly yours,
SWEENEY & BORER
Paul T.
