BORER <br />TO LITTLE- CANADA F.11/24 <br />(8) Any peace officer may enter, inspect and search the <br />premises of the licensee during business hours without a search <br />and seizure warrant and may seize all intoxicating liquor found <br />on the licensed premises in violation of Subdivision 7. The <br />licensee shall permit police officers, fire inspectors, and <br />other agents of the City to inspect and examine the place of <br />business. The refusal on the part of an applicant or licensee <br />to permit such inspection shall be sufficient for denial, <br />revocation or suspension of the license. <br />(9) There shall be no dancing, exhibitions or <br />entertainment on the premises of a non - intoxicating malt liquor <br />licensee unless said licensee holds a "On-Sale B Tavern" <br />license. <br />(10) No non- intoxicating malt liquor licensee shall allow <br />music on the premises between the hours of 9:00 o'clock p.m. and <br />9:00 o'clock a.m., except where such premises are duly licensed <br />as "On -Sale B Tavern." Such licensee shall, however, be <br />permitted to operate a radio or phonograph between the hours of <br />9:00 o'clock p.m. and 9:00 o'clock a.m., so long as said radio <br />or phonograph is not an annoyance to occupants of nearby <br />premises, and does not violate local ordinances and State law <br />defining excessive noise as a public nuisance. <br />702.080. VIOLATION BY AGENT. Every licensee is <br />responsible for the conduct in the licensed establishment and <br />any sale of alcoholic beverages by any employee authorized to <br />sell such beverages is the act of the licensee. <br />702.090. HOURS OF SALE. No non - intoxicating malt liquor <br />shall be sold between the hours of 1:00 o'clock a.m, and 8:00 <br />o'clock a.m. on the days of Monday through Saturday, nor between <br />1:00 o'clock a.m. and 12:00 o'clock noon on Sundays. No <br />"On -Sale" licensee shall permit the consumption of <br />non - intoxicating malt liquor during the hours when sale is <br />prohibited, except that the licensee shall be allowed a 30 <br />minute period following closing to clear the premises. Any <br />customer purchasing non - intoxicating malt liquor prior to 1:00 <br />o'clock a.m., may consume such beverage on the premises up <br />until 1:30 o'clock a.m. Under no circumstances shall any <br />individuals, whether or not customers, other than the owners or <br />employees of the licensee, be allowed to remain on the premises <br />after 1:30 o'clock a.m. <br />702.100. RESTRICTIONS ON PURCHASE AND CONSUMPTION. <br />(1) Provisions of Minnesota Statutes §340A are hereby <br />incorporated by reference into this ordinance, and the sale, <br />-7- <br />Page 59 <br />
