protection services to the MUNICIPALITIES with which the COUNTY has Agreements for 1991, including, but not limited to the following: salaries of employees engaged in performing said services, including vacation and sick leave; mileage; uniforms; public employees retirement contributions; workers' compensation, automobile, general liability and police professional liability insurance costs or the cost of self insurance; general overhead, including indirect expenses and supplies, radio unit expense, health and welfare expense. Costs as used herein shall not include items of expense attributable to services or facilities normally provided or available to all cities within the COUNTY as part of the COUNTY'S obligation to enforce State law. Computation of actual costs hereunder shall be made by the Ramsey COUNTY Budgeting and Accounting Division based on information provided by the Sheriff. 2. The COUNTY shall bill the MUNICIPALITY on a monthly basis in an amount equal to one - twelfth (1/12) of the 1991 Budget Estimate. The MUNICIPALITY shall pay the COUNTY within thirty (30) days of receipt of the monthly statement. At the close of the contract year, the COUNTY will reconcile the 1991 Budget Estimate and 1991 actual costs and shall either give a credit to the MUNICIPALITY or bill the MUNICIPALITY for additional costs in excess of the Budget Estimate. 3. The 1991 Budget Estimate is attached hereto and incorporated herein by reference as Exhibit A. Attached to the 1991 Budget Estimate is the summary of the 1991 law enforcement contract cities phase -in plan. This plan phases in the old budget formula with the new District Patrol Plan. Should this contract be extended as provided in subparagraph 4 of this Article IV, 1992 subsequent budget estimates for law enforcement services will be prepared on the District Patrol Plan format as provided in Exhibit A. The phase -in plan is only to be used for calendar year 1991. 4. An estimate of the costs for 1992 shall be furnished using the District Plan format by the COUNTY to the MUNICIPALITY no later than September 1, 1991. Said estimate shall be for the limited purpose of better enabling the MUNICIPALITY to estimate its budget. It is understood by the parties to this Agreement that said estimate shall in no way prevent the COUNTY from charging its actual costs. If MUNICIPALITY evidences its acceptance of said 1992 Budget Estimate in writing prior to November 30, 1991, this contract shall be extended through December 31, 1992. V. GENERAL PROVISIONS 1. It is understood that prosecutions for violations of ordinance or state statutes, together with disposition of all fines collected pursuant thereto, shall be in accordance with the Ramsey County Municipal Court Act, Minnesota Statutes Chapter 488A. -4- Page 60
