DEVELOPMENT CONTRACT <br />AGREEMENT, dated , 19 , by and between <br />the CITY OF LITTLE CANADA, a Minnesota municipal corporation <br />( "City ") and ROGER STANKE, an individual ( "Developer "). <br />1. Request for Approval for a Temporary Occupancy Permit <br />(the "Permit "). The Developer has asked the City to approve a <br />Temporary Occupancy Permit for the building located at 209 Ryan <br />Drive., legally described as Lot 1, Block 1, Ryan Industrial <br />Park. <br />2. Conditions of Approval. The City hereby approves the <br />permit on condition that the Developer enter into and guarantees <br />compliance with the terms of this agreement. <br />3. Compliance with Laws and Regulations. The Developer <br />represents to the City that to the best of his knowledge the <br />Property will comply with all county, metropolitan, state and <br />federal laws and regulations, including, but not limited to <br />environmental regulations. If the City determines that the <br />Property does not comply as approved, the City may, at its <br />option, refuse to allow any work on the Property until the <br />Developer does comply. Upon the City's demand, the Developer <br />shall cease work until there is compliance. Notwithstanding <br />anything in this Contract to the contrary, to the fullest extent <br />permitted by state law, the City may require compliance with any <br />amendments to the City's Comprehensive Plan, zoning, platting or <br />dedication requirements enacted after the date of this Contract. <br />4. Fire Prevention System. The Developer shall install a <br />sprinkler system approved by the City for the Property. The <br />Developer shall also be responsible for installing the service <br />'connection line from his property to the existing water main on <br />Ryan Drive. The Developer shall provide all necessary <br />maintenance of the service connection and the roadway until such <br />time as the City chooses to reconstruct or rehabilitate the <br />system. All repairs to the system shall commence within 72 <br />hours from the onset of the problem and shall be completed no <br />later than one (1) week after the onset of the problem. <br />5. License. The Developer hereby grants the City, its <br />agents, employees, officers and contractors a license to enter <br />the Property to perform all necessary inspections deemed <br />appropriate by the City until the sprinkler system is fully <br />installed and connected by the Developer. The license shall <br />expire after the cessation of activities pursuant to the <br />Development Contract. <br />-1- <br />Page 9 <br />
