DEC -12 -1990 16:51 FROM SWEENEY & BORER <br />TO LITTLE- CRNRDR P.05 /08 <br />recyclable materials accumulated in recycling containers set out <br />for the purpose of recycling at any residence in the City <br />receiving garbage and refuse collection. <br />(H) Refuse. Refuse is putrescible and nonputrescible <br />solid waste, including garbage and rubbish. Refuse specifically <br />excludes yard waste, recyclables, and toxic and hazardous <br />wastes. Refuse further excludes industrial, commercial, <br />agricultural and construction garbage or rubbish and wastes. <br />(I) Residential Dwelling Unit. A structure or portion <br />thereof, designated or used predominately for residential <br />occupancy of a continued nature, including one - family dwellings, <br />two - family dwellings, and multiple - dwellings of three (3) or <br />more family dwelling units, either rental or owner occupied, but <br />not including motels and hotels. <br />(J) Rubbish. Rubbish is nonputrescible solid waste, <br />including ashes, consisting of both combustible and <br />noncombustible wastes, including, but not limited to, wood, <br />bedding, concrete, and other non - reusable wastes. Rubbish also <br />includes nonrecyclable types of glass, paper, cardboard, and <br />metal cans. <br />(K) Toxic and Hazardous Wastes. Toxic and hazardous <br />wastes are waste materials, including, but not limited to, <br />poisons, pesticides, herbicides, acids, caustics, pathological <br />wastes, radioactive materials, flammable or explosive materials, <br />and similar harmful chemicals and wastes, which require special <br />handling, and which must be disposed of in a manner to conserve <br />the environment and protect the public health and safety. <br />(L) Yard Waste. Yard waste includes grass clippings, <br />brush, and leaves, and specifically excludes limbs, recyclables <br />and refuse. <br />Section 2. Chapter 809.055 of the Municipal Code of the <br />City of Little Canada is hereby added to read as follows: <br />809.055. MANDATORY PROVISION OF RECYCLING COLLECTION <br />SERVICES. All licensees providing service to residential <br />dwelling units shall provide for the collection and disposal of <br />recyclable materials, and providing recyclable collection <br />services shall be a condition of the license. On or before the <br />15th day of each month, the licensee shall file a written <br />statement of total tonnage of recyclable materials and refuse <br />collected by the licensee in the previous month with the <br />Superintendent of Public Works. On or before the 15th day of <br />January of each year, each licensee must provide the <br />Superintendent of Public works with the name and address of any <br />-2- <br />Page 22 <br />
