As you will recall, I had requested a change in Paragraph 6.2 in my correspondence of April 3, and in subsequent phone conversations. You indicated that the City of St. Paul is not willing to change the language of the proposed agreement. You did indicated, however, that the indemnification clause in the agreement should be read as consistent with and limited to the requirements set forth in Minn. Stat. §466.07. An express and understood condition of the agreement between the City of Little Canada and the St. Paul Fire Department will be that the City's obligation to defend and indemnify agents and employees of the St. Paul Fire Department shall be limited by the provisions in Minn. Stat. §466.07. Please forward to me written confirmation that this letter accurately reflects our understanding in this matter. Once written confirmation on this issue is received from you, the Contract for Hazardous Materials Response will be considered by the Little Canada City Council for approval.
