By way of this letter, Mr. McCloskey confirms that the <br />City of St. Paul agrees that the City's obligation to defend and <br />indemnify agents and employees of the St. Paul Fire Department <br />will be limited by the provisions of Minn. Stat. §466.07. As a <br />result, the City of Little Canada's pledge of indemnification <br />shall not extend to the damages resulting from malfeasance in <br />office, willful neglectful duty, or bad faith. <br />As a result, we are now able to approve the Contract for <br />Hazardous Materials response as to form.
