All lighting shall be hooded and so directed that the light source shall not be <br />visible from the public right -of -way or from neighboring residential uses, and <br />shall be in compliance with Section 903.020.1 of the Zoning Ordinance. <br />15. All other provisions and requirements as deemed necessary by the City <br />Council. <br />16. The applicant complies with the provisions of Section 921 of the Zoning <br />Ordinance. <br />Very few of these requirements can be verified from the proposed site plan. It appears <br />that screening will require additional material to comply with the ordinance <br />requirements, and that the 60% maximum coverage area appears to be met, with about <br />50% of the site dedicated to outdoor storage. Vehicular parking is provided in the front <br />and to the south of the building, with about 30 spaces identified for the 7,200 square <br />foot building. A typical requirement of about 20 parking spaces would be adequate, in <br />most cases, for an industrial building of this size. <br />If the CUP is to proceed, a condition that the applicant provides a plan that verifies <br />compliance with the required CUP provisions should accompany an approval <br />recommendation. <br />Approval of the amendment request would not result in any increase in outdoor storage <br />on the site — it would only have the effect of transferring some of the storage previously <br />dedicated to an on -site tenant to that of an off -site tenant. The particulars of compliance <br />with the terms of the original permit are not affected by this change. <br />Effect of CUP Approval and IUP Approval. <br />The proposed CUP and IUP presume compliance with the code provisions regulating <br />those uses. As noted above, most of the proposed changes are not identified in detail <br />in the application materials, and require clarification for formal consideration. It is also <br />important to note that Conditional Use Permit approval is valid for one year from the <br />date of approval, and where the permit has not be utilized for that period, the approval <br />expires. This is also true for permits that are used, but then lapse for the one year <br />period in subsequent years. <br />With regard to the IUP, the City has typically granted these permits for a period of up to <br />5 years, with a new permit necessary at the end of that term if the applicant wishes to <br />continue to off-site storage use. <br />Summary and Recommendation <br />The proposed outdoor storage CUP and IUP are allowed by the zoning ordinance, but <br />only a few of the requirements of the ordinance can be verified by the materials <br />submitted as part of this application. This permit should be withheld until additional <br />detail is provided by the applicant. <br />In summary, if the City wishes to consider approval of the permit, staff recommends the <br />following: <br />9 <br />
