Hanson <br />When the City purchased the McNamara property for the Fire <br />Station, Mr. McNamara had tenants residing in the building <br />prior to our acquisition. As part of the uniform act, the <br />City Attorney's office did an analysis of their eligibility <br />for relocation benefits. Based on this analysis, it was <br />determined that they were not eligible for any relocation <br />benefits. We have now received a notice from one of the <br />tenants, Mr. Gatti, that he is appealing that <br />determination. <br />Pursuant to due process requirements, a hearing should be <br />held to make a decision on this appeal. Attached is a <br />letter from Paul Ostrow of the City Attorney's office that <br />discusses the process we should follow. With this memo, I <br />am recommending that we call for the hearing to be held on <br />July 10, 1991 as part of our regular Council meeting. If <br />the Council is in agreement with this date for a hearing, I <br />will get the appropriate notices to the appealing party. <br />Should you have any comments or questions regarding this <br />matter, they can be brought to the attention of either <br />myself or the City Attorney at Wednesday's meeting. <br />JRH:kpv <br />Enclosures <br />Page 49 <br />
