(10) No nonintoxicating malt liquor licensee shall allow <br />music on the premises between the hours of 9:00 o'clock p.m. and <br />9:00 o'clock a.m., except where the licensee has obtained a <br />"Dancing and Entertainment" license, or the premises are covered <br />by a temporary "on -sale" license. Such licensee shall, however, <br />be permitted to operate a radio or phonograph between the hours <br />of 9:00 o'clock p.m. and 9:00 o'clock a.m., so long as said <br />radio or phonograph is not an annoyance to occupants of nearby <br />premises, and does not violate local ordinances and State law <br />defining excessive noise as a public nuisance. <br />702.080. VIOLATION BY AGENT. Every licensee is <br />responsible for the conduct in the licensed establishment and <br />any sale of alcoholic beverages by any employee authorized to <br />sell such beverages is the act of the licensee. <br />702.090. HOURS OF SALE. No nonintoxicating malt liquor <br />shall be sold between the hours of 1:00 o'clock a.m. and 8:00 <br />o'clock a.m. on the days of Monday through Saturday, nor between <br />1:00 o'clock a.m. and 10:00 o'clock a.m. on Sundays. No <br />"On -Sale" licensee shall permit the consumption of <br />nonintoxicating malt liquor during the hours when sale is <br />prohibited, except that the licensee shall be allowed a 30 <br />minute period following closing to clear the premises. Any <br />customer purchasing nonintoxicating malt liquor prior to 1:00 <br />o'clock a.m., may consume such beverage on the premises up until <br />1:30 o'clock a.m. Under no circumstances shall any individuals, <br />whether or not customers, other than the owners or employees of <br />the licensee, be allowed to remain on the premises after 1:30 <br />o'clock a.m. <br />702.100. RESTRICTIONS ON PURCHASE AND CONSUMPTION. <br />(1) The provisions of Minnesota Statutes §340A are hereby <br />incorporated by reference into this ordinance, and the sale, <br />purchase or possession of alcohol contrary to State law shall be <br />a violation of this ordinance. <br />(2) It shall be unlawful for any person to consume <br />nonintoxicating malt liquor in any theater, recreation hall, <br />center, dance hall, ball park, or other place of public <br />gathering used for the purpose of entertainment, amusement or <br />playing of games, unless the owner or lessee of the property or <br />sponsor of the event has obtained a license or permit issued by <br />the Park and Recreation Director or his designee. <br />702.110. SUSPENSION AND REVOCATION. The Council shall <br />either suspend for up to 60 days or revoke any nonintoxicating <br />malt liquor license, or impose a civil fine not to exceed <br />-8- <br />Page 65 <br />
