Monday, Tuesday, Wednesday and Thursday, and before the hour of <br />eight o'clock a.m., or after the hours of ten o'clock p.m. on <br />Friday and Saturday, and no such "Off -Sale" sales of liquor <br />shall be made at any time on Sunday. No "Off -Sale" shall be <br />made on New Years Day, January 1; Independence Day, July 4; <br />Thanksgiving Day or Christmas Day, December 25; but on the <br />evenings preceding such days, notwithstanding the above <br />provisions, "Off -Sale" sales may be made until ten o'clock p.m. <br />(3) No "On -Sale" licensee shall permit the consumption of <br />intoxicating liquor on the premises during the hours when sale <br />is prohibited, except that the licensee shall be allowed a <br />thirty minute period following closing to clear the premises. <br />Any customer purchasing intoxicating liquor prior to 1:00 <br />o'clock a.m. may consume such beverage on the premises until <br />1:30 o'clock a.m. Under no circumstances shall any individuals, <br />whether or not customers, other than the owners or employees of <br />the licensee, be allowed to remain on the premises after 1:30 <br />o'clock a.m. <br />703.150. EXCEPTIONS OF SALE. This Chapter shall not be <br />construed to prohibit the sale of wine for sacramental purposes <br />by any person duly licensed by the State Liquor Control <br />Commissioner, nor shall this Chapter be construed to prohibit <br />the sale of medicine, nor of industrial alcohol designed for <br />mechanical, chemical, scientific, pharmaceutical or industrial <br />purposes nor to compound or preparations containing alcohol, if <br />such compounds or preparations are not potable as a beverage, <br />nor shall it be construed to prohibit the sale of intoxicating <br />liquor for medicinal purposes by a duly licensed and registered <br />pharmacist or druggist upon a bona fide prescription, in <br />writing, by a physician or dentist. <br />703.160. RESTRICTIONS ON PURCHASE AND CONSUMPTION. <br />(1) The provisions of Minnesota Statutes §340A are hereby <br />incorporated by reference into this ordinance, and the sale, <br />purchase or possession of alcohol contrary to State law shall be <br />a violation of this ordinance. <br />(2) It shall be unlawful for any person to consume <br />intoxicating liquor in any theater, recreation hall, center, <br />dance hall, ball park, or other place of public gathering used <br />for the purpose of entertainment, amusement or playing of games, <br />unless the owner or lessee of the property or sponsor of the <br />event has obtained a license or a permit issued by the Park and <br />Recreation Director, or his designee. <br />703.170. SUSPENSION AND REVOCATION. The Council shall <br />either suspend for up to 60 days or revoke any intoxicating <br />-18- <br />Page 75 <br />
