During. the time that Little Canada Road was upgraded, additional <br />right -of -way was acquired from some parcels abutting the road. <br />The Unocal site was one in which land was acquired for the <br />additional right -of -way. The exact amount of land acquired is not <br />know at this time without a property records search or an <br />official survey being done on the site. Due to this event, the <br />property has lost depth at the front yard which limits the space <br />and use of the remaining front yard. This condition appears to <br />limit the applicant and how the pump islands and canopy may be <br />laid out. <br />Canopies over pump islands appear now to be standard in the <br />industry providing weather protection for their customers. This <br />variance request will not therefore concur on the applicant any <br />special privileges that would be denied to any other in this <br />district. <br />Based upon the existing conditions affecting this lot, our office <br />would recommend granting a variance from the front yard setback <br />to allow construction of a canopy, as shown on the submitted site <br />plan, provided that the applicant can document that they lost at <br />least four feet in the Little Canada Road upgrade and that the <br />following items are addressed to the satisfaction of the Planning <br />Commission: <br />1. The applicant is aware that the circulation pattern for the <br />tanker trunks and the turning radius is at the minimum and <br />potential problems may occur if the tanker trunks do not <br />enter the property just right. <br />2. All necessary building permits are obtained from the <br />appropriate governing bodies for the canopy and underground <br />tanks. <br />3. If signage is proposed, it must comply with the <br />recommendations in this report and it must comply with City <br />requirements and City permits obtained. <br />4.
