Hanson As part of the City Project No. 90 -21 - DeSoto Street /Costa Estates Improvement Project, it was determined that three easements were needed for the north end of Desoto Street on the west side. These easements should have been obtained in 1978 in relation to the watermain project that was conducted at that time. However, after reviewing our files, it appears that those easements were not secured. Two of the easements had been paid for at that time and I have since met with the respective land owners and they have signed easement forms. I have also given them some information discussing the likelihood of future special assessments. (See letter enclosed.) I would ask that the Council ratify the acceptance of the easements from Dave Frattalone and the estate of Mariano Frattalone as secured. Regarding the easement needed from AIC Corporation, it should be noted that it may not be possible to have an easement that is recordable due to delinquent taxes and some judgments against the property. I would ask that the Council grant me the authority to negotiate either an easement document or right of entry with the owner to allow the completion of the DeSoto Street project. It should be understood that by obtaining either of these documents, the City may still have to deal with the subsequent property owner to finalize the easement arrangements. However, we would be able to complete our improvements in the meantime with the possibility of having a valid easement in the
