Hanson <br />As part of the City Project No. 90 -21 - DeSoto Street /Costa <br />Estates Improvement Project, it was determined that three <br />easements were needed for the north end of Desoto Street on <br />the west side. These easements should have been obtained <br />in 1978 in relation to the watermain project that was <br />conducted at that time. However, after reviewing our <br />files, it appears that those easements were not secured. <br />Two of the easements had been paid for at that time and I <br />have since met with the respective land owners and they <br />have signed easement forms. I have also given them some <br />information discussing the likelihood of future special <br />assessments. (See letter enclosed.) I would ask that the <br />Council ratify the acceptance of the easements from Dave <br />Frattalone and the estate of Mariano Frattalone as secured. <br />Regarding the easement needed from AIC Corporation, it <br />should be noted that it may not be possible to have an <br />easement that is recordable due to delinquent taxes and <br />some judgments against the property. I would ask that the <br />Council grant me the authority to negotiate either an <br />easement document or right of entry with the owner to allow <br />the completion of the DeSoto Street project. It should be <br />understood that by obtaining either of these documents, the <br />City may still have to deal with the subsequent property <br />owner to finalize the easement arrangements. However, we <br />would be able to complete our improvements in the meantime <br />with the possibility of having a valid easement in the <br />
