* 916. "FP ", FLOODPLAIN DISTRICT <br />916.010. PURPOSE. The intent of this Section is to provide <br />for the protection and preservation of water channels and those <br />portions of the adjoining floodplains which are reasonably <br />required to carry and discharge a regional flood and are subject <br />to inundation by regional floods. (Regional flood shall be <br />defined according to standards established by the Minnesota <br />Department of Natural Resources and illustrated on the Little <br />Canada Flood Insurance Rate Maps (FIRM) effective 3 November <br />1982.) It is the intent of this district to be applied to those <br />areas which if left unrestricted, could result in loss of life <br />and property, health and safety hazards, disruption of commerce, <br />utilities and governmental services, extraordinary public <br />expenditures for floodplain protection and relief and impairment <br />of the tax base, all of which adversely affect the public health, <br />safety and general welfare. This district is furthermore created <br />and applied in compliance with requirements of Minnesota <br />Statutes, Chapters 103F and 462, as amended. In addition, <br />Minnesota Regulations N.R. 85, as may be amended, shall be <br />consulted in administering and applying this district. <br />916.020. WARNING AND DISCLAIMER OF LIABILITY. This Section <br />does not apply that areas outside the "FP ", Floodplain District <br />boundaries or land uses allowed within this district will be free <br />from flooding or flood damages. This Section shall not create <br />liability on the part of the City of Little Canada or any officer <br />or employee thereof for any flood damages which result from <br />reliance on this Ordinance or any administrative decision <br />lawfully made thereunder. <br />916.030. DISTRICT APPLICATION. The "FP ", Floodplain <br />District shall be applied to and superimposed upon all districts <br />as existing or amended by the text and map of this Ordinance. <br />The regulations and requirements imposed by the "FP ", Floodplain <br />District shall be in addition to those established by other <br />districts of this Ordinance. The "FP ", Floodplain District shall <br />be established based upon the specific information contained in <br />the Flood Boundary, Floodway and Flood Insurance Rate Maps (dated <br />3 November 1982) and the Flood Insurance Study for the- City of <br />Little Canada (dated 3 May 1982). All aforementioned official <br />maps and documents are hereby adopted by reference and declared <br />to be an integral part of this Ordinance. <br />A. Regulatory Flood Protection Elevation. The Regulatory <br />Flood Protection Elevation shall be an elevation no <br />lower than one (1) foot above the elevation of the <br />regional flood plus any increases in flood elevation <br />caused by encroachments on the flood plain that result <br />from designation of a floodway. <br />Page 28 <br />
