MINUTES <br />PLANNING COMMISSION <br />SEPTEMBER 12, 1991 <br />Bendel suggested that the matter be tabled and that the <br />Planning Commission ask the staff to review the <br />materiality of their distinction between auto and truck <br />repair. Bendel stated that he was inclined to vote <br />against the ordinance change, but is unclear how the <br />distinction was made between the two uses. <br />Drabik asked how many major and minor auto repair <br />businesses there were in the City. <br />The Planner replied that staff will obtain this <br />information. <br />Bob DeBace suggested that the use be allowed as a <br />conditional use in the District. That way the <br />applicant would have to make application, and meet the <br />terms and conditions set forth by the City before a <br />permit is granted. DeBace felt this would offer the <br />City good control. <br />Mr. Bendel recommended that the application for Zoning <br />Ordinance Amendment submitted by Duane Meron be tabled <br />and that City Staff review their determination that the <br />auto repair use not be grandfathered in, specifically <br />evaluating the materiality of their distinction between <br />truck repair and major auto repair. <br />Motion seconded by Garske. <br />Motion carried 7 - 0. <br />APPEAL Mr. Jim McBride, McBride Construction, representing <br />34 LITTLE Jim Marshall, appeared before the Commission to appeal <br />CANADA ROAD the Council's denial of application for Conditional Use <br />Permit and Variance to allow the improvement of a <br />non - conforming single - family structure to bring the <br />structure up to minimum standards and allow <br />improvements to the property in excess of 50% of the <br />fair market value. The property in question is located <br />at 34 Little Canada Road. <br />Bendel pointed out the concerns expressed at the <br />previous Planning Commission meeting regarding parking <br />and appearance of the structure. Bendel pointed out <br />that McBride assured the Commission that he would put <br />together a landscape plan for the property. <br />McBride presented a revised plan that was presented to <br />the Council at its last meeting. <br />Garske asked why Jim Marshall is now the applicant. <br />Page 5 <br />
