Hanson <br />Attached is a letter received from Mr. Gordie Howe regarding his <br />request for two building permits for lots in the Frederickshaven <br />Subdivision. In our Developer's Agreement with the Schletty Family <br />Partnership, one of the conditions was that no building permits would <br />be issued prior to the installation of the first lift of bituminous <br />surface. Also, City Ordinance Section 501.030 restricts the issuance <br />of building permits unless the building site is located adjacent to <br />an existing street which is dedicated and maintained as a City <br />street, or unless provision for street construction has been made in <br />full compliance with City Codes. <br />In order to accommodate the development, it would be my <br />recommendation that we grant the issuance of two building permits as <br />requested subject to the following conditions. <br />* No construction activity can proceed prior to the <br />completion of grading work for the street area for the <br />extension of Sunrise Drive. <br />* The City is not guaranteeing access to the building site <br />to the builder during the construction of public <br />improvements. <br />* Builder is to indemnify and hold harmless the City and the <br />Fire Department from potential losses resulting from the <br />lack of a fully improved access to the building site. <br />These losses could be to property or person. <br />* Builder is to take into account finished road grade when <br />determining elevation of the housing structure. <br />* Certificates of occupancy will be withheld until public <br />improvements are installed pursuant to City Ordinances. <br />(First lift of bituminous is satisfactory) <br />Page 1 <br />
