MINUTES <br />PLANNING COMMISSION <br />NOVEMBER 14, 1991 <br />Variance to the Code to allow improvements to the <br />property in excess of 50% of the fair market value of <br />the non- conforming structure at 34 Little Canada Road <br />as requested by Jim Marshall. <br />Keis noted that no new information has been presented <br />to the Commission on this matter. <br />Jim McBride, McBride Construction, appeared before the <br />Commission representing the applicant, Jim Marshall. <br />McBride reported that they have discussed this matter <br />with an attorney. It is now their decision to not <br />pursue the Conditional Use Permit and Variance, but to <br />merely repair the structure. Repairs will be made to <br />meet minimum UBC standards, and cost of these repairs <br />will be under the $4,500 figure as outlined in the 50% <br />rule. <br />McBride stated that it not their intention to lose the <br />property, and felt that the matter has been handled <br />unfairly. McBride reported that their intent had been <br />to make the structure more attractive. McBride <br />reported that his attorney has recommended that they <br />apply for a building permit to repair the structure, <br />and McBride reported that he has made building permit <br />application. McBride stated that even though the <br />building is not what the City wants to see on the site, <br />there are no laws which stop a cabin from existing <br />where it does, and indicated that the building is <br />grandfathered in. The only problem is that the cabin <br />does not meet UBC standards, and it is their intention <br />to bring it up to standard. <br />Mr. McBride indicated that there are actually very <br />limited repairs that will be necessary in order to <br />bring the structure up to UBC standards. McBride <br />stated that the structure is small and easy to repair. <br />Keis asked whose opinion it was that the structure only <br />needed limited repairs. <br />McBride replied that it doesn't matter whose opinion is <br />involved, it is a matter of what is required by the <br />UBC. <br />Keis asked who will make the determination that only <br />limited repairs are necessary other than Mr. McBride. <br />Keis asked what happens if the $4,500 doesn't bring the <br />structure up to UBC standards. <br />The City Planner suggested that the opinion of the City <br />Attorney may be necessary. <br />Page 4 <br />
