Honorable Mayor, City Council Members, Todd and Gail Hagen <br />Planning Commission Chair and Members 52 East Little Canada Road <br />Little Canada City Hall Little Canada, MN 55117 <br />515 Little Canada Road <br />Little Canada, MN 55117 <br />November 22, 1991 <br />Re: Property along north -side of Round Lake in the City of Little <br />Canada, Minnesota <br />Dear Members of the City Council and Planning Commission: <br />This letter is in rebuttal to the Thursday, October 10, 1991 Little <br />Canada Planning Commission meeting which we attended in connection <br />with the above referenced matter. It was our understanding this <br />meeting was held to discuss, among other things, the future of the <br />land lying between Round Lake and Little Canada Road, west of the <br />Soo Line Railroad. We attended said meeting because we are one of <br />ten (10) affected property owners. <br />We feel the Planning Commission's recommendation of rezoning our <br />property to Park /Open Space or Planned Unit Development in "100 <br />years" was sarcastically premature to say the least. According to <br />Minnesota Statutes, Section 462.357, Subdivision 3, a public <br />hearing must be held which, among other things, requires published <br />and mailed notice to all affected property owners so they may be <br />heard. We found out about the meeting by calling City Hall, hence <br />we were the only property owners in attendance. <br />We would like to make ourselves clear that we are against any <br />rezoning that will threaten the salability and market valuation of <br />our property. <br />We feel the City, in its attempt to rezone the area, is trying to <br />undermine the "Undue hardship" intent of Minnesota Statutes, <br />Section 462.357, Subdivision 6 (2), by making it almost impossible <br />for those who need to perform extensive renovations to or rebuild <br />their property outside the literal provisions of the ordinance, to <br />do so. <br />We feel it is very unfair to make us suffer for a problem the City <br />itself created. To blame any of this on the property owners and <br />the constant questioning of us as to why we bought this property is <br />cruel beyond belief. The Commission's "Red flag" attempt at <br />protecting other prospective buyers from purchasing our property <br />seems to be unfair targeting. If the City is serious about <br />Park /Open Space zoning, we feel it is their responsibility to buy <br />everyone out at once. <br />We cannot stress enough that the City should cherish the property <br />along the north -side of Round Lake and encourage its further <br />single- family development as was the south -side a few years ago. <br />We perceive our property as part of the block around the Lake and <br />have nothing to do with the commercial land across the road. We <br />would like to note that our homes were in the area before the Road <br />and the commercial development. <br />Page 1 <br />
