In addition to <br />several minor drafting changes, I have revised the Ordinance <br />based upon the deliberations of the City Council on October 23, <br />1991, and our subsequent conversations. <br />You will note that Sections 815.010(4), 815.020(A)(6), and <br />815.025(C) have been revised to provide that an organization <br />cannot have an officer, director, employee, member or a <br />consultant who has been convicted of a felony or gross <br />misdemeanor if that offense has occurred within the past five <br />years. This places those sections in conformity with Minnesota <br />Statute 5349.16. Due to the provisions of the Criminal <br />Rehabilitation Act, Minnesota Statute §364.01 et. seq., it is <br />our opinion that the Ordinance should not place restrictions on <br />individuals due to prior convictions in excess of those provided <br />in state statutes. <br />We have added Section 815.020(A)(8), which requires that an <br />applicant provide information as to the financial institutions <br />used by the organization at the time of the application. <br />Section 815.025(H) has also been added and requires that the <br />financial information be supplemented if the nature of the <br />accounts or financial institutions used by the organization <br />change. Finally, Section 815.025(H) provides that a licensee <br />must consent to access to its financial records and failure to <br />consent will constitute grounds for revocation of a bingo hall <br />license or premises permit. <br />Page 2 <br />
