o The City approved this lot split with some knowledge of the <br />easements that create restricted building area. <br />o Taking into account the setback restriction, there is still <br />35 feet of lot depth between the pipeline easement and <br />setback. Although this is not a lot of depth, it is still <br />possible to build a house within setbacks. <br />o Mr. Brausen's site plan indicates that the house is to be <br />built at an angle, causing the reduced setback. It may be <br />possible to build the house in a straight line parallel to <br />the pipeline easement and meet setbacks. <br />CONCLUSION <br />As the City reviews this request, it must look at the fact that <br />the lot split the City approved has obvious constraints with two <br />easements. This past action must be taken into account when <br />making its decision. However, the applicant is creating the <br />setback problem by constructing the house at an angle within the <br />setback when there appears to be alternatives to this house <br />location. <br />Applications for variance reflect City policy and must be made by <br />City Officials. Our office, through this report, can only make <br />comments and suggestions through our discussion.
