NPR -21 -1990 1A :n3 FRnf9 <br />City of Little Canada <br />March 21, 1991 <br />Page Two <br />Tn 94544533 P.03 <br />2 The city should be issuing a permit form which would contain <br />a. contract including, but not limited to, the city rules such <br />as clean up and the appropriate hold - harmless /indemnification <br />paragraph. The vendor should then be signing such a permit. <br />The city should be in communication with the city's legal <br />counsel for the appropriate language. The LMCIT staff <br />attorneys may have samples and may be able to assist you in <br />this area as well. <br />3. Consideration should be given to permitting only 3.2 canned <br />beer on city property. We are concerned that by restricting <br />this to canned beer rather than keg beer, individuals will <br />consume less alcohol than they would if they were drinking <br />stronger alcoholic beverages. Additionally, it has been our <br />experience that people who drink canned beer tend to drink <br />less beer than those who are obtaining their beer through a <br />keg. <br />4. The police department should be informed when there is going <br />to be alcohol served on city property. At a minimum, city <br />police officers can patrol the area and may want to provide <br />additional police protection services in the area where the <br />alcohol is going to be consumed. <br />5. We are very concerned about the alcohol on city property and, <br />therefore, have made a number of these recommendations to a <br />number of cities throughout the State of Minnesota. If the <br />city finds that it is very difficult to enforce these <br />recommendations, then strong consideration should be given to <br />prohibiting alcohol on city property altogether. <br />I do hope this information will be of help to you and, if you do <br />have any further questions, please feel free to contact me or the <br />LMCIT staff attorneys. <br />Sincerely, <br />kCi <br />Dou as D.
