MAR -26 -1991 12 :51 FROM SWEENEY & BORER <br />ORDINANCE NO. <br />TO LITTLE- OANRDA P.03 %13 <br />AN ORDINANCE ADDING CHAPTER 817 TO THE <br />MUNICIPAL CODE OF THE CITY OF LITTLE CANADA, <br />RELATING TO THE LICENSING OF PAWN SHOPS <br />THE CITY COUNCIL OF LITTLE CANADA HEREBY ORDAINS AS FOLLOWS: <br />Section 1. <br />Chapter 817 of the Municipal Code of the City of Little <br />Canada is hereby added to read as follows: <br />817. PAWN SHOPS AND PAWNBROKERS <br />817.010. Definitions. <br />(A) For purposes of this section the terms defined in this <br />subsection have the meanings given them. <br />(B) "Pawnbroker" means a person who loans money on deposit <br />or pledge of personal property, or other valuable thing, or <br />who deals in the purchasing of personal property or other <br />valuable thing on condition of selling the same back again <br />at a stipulated price, or who loans money secured by <br />chattel mortgage on personal property, taking possession of <br />the property or any part thereof so mortgaged. <br />(C) "Secondhand goods dealer" means a person whose regular <br />business includes selling or receiving tangible personal <br />property (excluding motor vehicles) previously used, <br />rented, owned or leased. <br />817.020. Exemptions. This section does not apply to or <br />include the following: <br />(A) The sale of secondhand goods where all of the <br />following conditions are present: <br />(1) the sale is held on property occupied as a <br />dwelling by the seller, or owned, rented or leased by <br />a charitable or political organization; <br />(2) the items offered for sale are owned by the <br />occupant; <br />(3) the sale does not exceed a period of 72 <br />consecutive hours; <br />Pag 9 11 <br />
