,..-J5_1991 17:09 FROM SWEENEY S BORER <br />TO LITTLE- CANRD1 P.07/15 <br />construction of the project, the Developers shall sign a <br />separate and formal waiver of special assessment appeal, and <br />said waiver is attached as Exhibit C. <br />9. Feasibility Study., The City shall prepare a <br />Feasibility Study for the project in order to provide an initial <br />evaluation and to set estimated costs. The Developers authorize <br />the City and its agents to undertake any and all investigation <br />required in order to confirm site conditions. <br />10. Grading and Drainage Study. The Developers shall <br />complete a Drainage and Grading Study as required for <br />subdivision approval and furnish said study to the City Engineer <br />for his use in preparing the Feasibility Study. <br />11. Setback Requirements, The Developers shall 2t*isure <br />that the existing home at 2972 Desoto Street retains the <br />appearance of a thirty foot setback. Compliance with the <br />requirements of this paragraph will be confirmed by survey with <br />the City Planner and the City Engineer. The Developers <br />acknowledge that they may be required to increase the street <br />right -of -way at that location to sixty feet in order to meet the <br />requirements of this paragraph. <br />12. License. The Developers hereby grant the City, its <br />agents and employees, a license to enter the above- described <br />property to perform all necessary work, maintenance and /or <br />inspections deemed appropriate by the City during the project. <br />The license shall expire after the public improvement is <br />-4- <br />Page 54 <br />
