SEVENTEENTH RIDER TO AGREEMENT THIS AGREEMENT, Made this _ day of , 1991 by and between the BOARD OF WATER COMMISSIONERS, CITY OF SAINT PAUL, hereinafter called "Board" and the CITY OF LITTLE CANADA, County of Ramsey, State of Minnesota, hereinafter called "City ", being the Seventeenth Rider to that certain Agreement made by and between said Board and said City the 13th day of July, 1966 and by this reference incorporated herein and made part hereof and with the same intent, purpose and effect as if said Agreement were set forth herein verbatim. WHEREAS, The Board is owner of a 160 foot wide right -of -way across the southwest one - quarter (SW 1/4) of Section Eight (8) Township 29 North. Range 22 West, County of Ramsey, hereinafter designated as "Premises "; and WHEREAS, The City desires permission to enter upon certain portions of said Premises to construct, maintain, repair and operate a public water main; and WHEREAS, The Board is willing to grant said permission to the City consistent with the requirements and safety of the works of the Board. NOW, THEREFORE, BE IT AGREED, In consideration of the mutual promises and agreements of the parties hereto, that: 1. The Board hereby grants permission to the City to construct, maintain, repair and operate a public water main in Board -owned right -of -way shown on attached Exhibit "A" in accordance with plans and specifications approved by and on file with the Board. 2. All disturbed areas of the Premises are to be restored by seeding and mulching. BE IT FURTHER AGREED, That the permission and authority granted by said Board to said City are subject to all the terms and conditions contained in that certain Agreement made by and between said Board and said City the 13th day of July, 1966 excepting Paragraph 42 thereof, which Agreement is incorporated herein by reference and made part hereof with the same force and effect as if set forth herein verbatim.
