Hanson <br />City Administrator <br />RE: Proposed Liquor Ordinance <br />Dear Joel: <br />Linda Fahey, Treasurer <br />2926 LaBore Road <br />Little Canada, MN 55109 <br />484 -2579 <br />February 19, 1991 <br />Thank you for soliciting our comments on the amended liquor ordinance. <br />As you know, we have in the past applied for temporary on -sale <br />licenses for both nonintoxicating and intoxicating liquor in <br />conjunction with our fundraising events. We do have several questions <br />and concerns regarding the temporary licenses: <br />701.010 (j) We do not own or permanently occupy the premises that <br />our events are held at (Fire Station, Spooner Park, St.John's School). <br />702.030 (2) & 703.040 (6) Requiring proof of financial responsibility <br />in excess of what is required by state law will put a financial <br />hardship on our organization. The ordinance as it is now written will <br />require us to buy costly liability insurance which will severely cut <br />into our fundraising profits. Since all of our proceeds are donated <br />back to the city, I think it would be in our mutual interest to remove <br />this requirement or perhaps reword it so the council can require it <br />only when they believe it is necessary. I think our past record <br />speaks for itself. We have been very cautious in the past when <br />serving liquor and I believe the added cost of liability insurance <br />would be wasted dollars. <br />702.040 (3) There is no fee listed for a "temporary" license. If <br />the intent is to charge $40.00 for all licenses, I think it is <br />unreasonable and should be lower than the cost of a license issued <br />under 703.050 (5). <br />702.060 (7) I assume this is a typographical error and should read <br />the same as 703.090 (7). <br />702.070 (7) This provision would not allow us to serve 3.2 beer and <br />setups at our annual fundraising dance. I see nothing wrong with <br />allowing this, and do not see any advantage to the city by <br />prohibiting it. <br />702.070 (9 & 10) & 703.100 (8) Assuming these provisions also apply <br />to temporary licenses, it would mean that we could not serve any <br />liquor at our annual dance. <br />702.090 At our various fundraising events, we typically start <br />serving at 10:00 am on Sunday and I see no problem with it.
