Hanson <br />At the Council meeting of January 23, 1991, the Council <br />approved the revised preliminary plat for Costa Estates. <br />During the discussion of this plat, it was apparent to me <br />that the intent of the majority of the Council was to <br />eliminate the requirement for paths to Pioneer Park as part <br />of this development. However, if you review the minutes <br />from that meeting, you will note that no action was taken <br />on this matter in the motion approving the revised plat. <br />Just to re -cap the previous events, on November 28, 1990 it <br />was the consensus of the Council that paths should not be <br />required as part of this development. However, no formal <br />motion was made at this time. On December 26, 1990 the <br />Council passed a motion "Reconsidering previous Council <br />action and accepting the Park Commission's recommendation <br />for walkway paths and easements from Vanderbie Road to <br />Desoto, at the developer's expense, as part of the Costa <br />Estates plat which is consistent with what the City has <br />required in similar developments." This motion is still in <br />effect at this time. <br />Therefore, if it is the intent of the Council to eliminate <br />the requirement for park paths, an action to rescind the <br />motion of December 26, 1990 is necessary. By agenda <br />scheduling, I am complying with the advance notice <br />requirements pursuant to Robert's Rules of Order. I have <br />reviewed this matter with the City Attorney, and he concurs <br />with this course of action should it be the Council's <br />desire. <br />JRH:kpv <br />Pat '014 <br />
